試用期不簽勞動合同合法嗎?

最(zui)近面(mian)試(shi)了(le)一(yi)家公司,但是公司說試(shi)用期不(bu)簽訂勞動合同(tong),這(zhe)樣做(zuo)合法嗎?

很多(duo)企業在(zai)(zai)試(shi)(shi)用期(qi)(qi)(qi)(qi)內(nei)不(bu)給予(yu)勞(lao)(lao)動(dong)者簽(qian)訂(ding)合(he)(he)同(tong),大多(duo)數都是要求通過試(shi)(shi)用期(qi)(qi)(qi)(qi)后才給予(yu)簽(qian)訂(ding)。 但(dan)在(zai)(zai)《勞(lao)(lao)動(dong)合(he)(he)同(tong)法(fa)》第十九條有明確規定“試(shi)(shi)用期(qi)(qi)(qi)(qi)包含在(zai)(zai)勞(lao)(lao)動(dong)合(he)(he)同(tong)期(qi)(qi)(qi)(qi)限(xian)內(nei)。勞(lao)(lao)動(dong)合(he)(he)同(tong)僅(jin)約(yue)定試(shi)(shi)用期(qi)(qi)(qi)(qi)的,試(shi)(shi)用期(qi)(qi)(qi)(qi)不(bu)成立,該期(qi)(qi)(qi)(qi)限(xian)為勞(lao)(lao)動(dong)合(he)(he)同(tong)期(qi)(qi)(qi)(qi)限(xian)。”所以在(zai)(zai)試(shi)(shi)用期(qi)(qi)(qi)(qi)也要簽(qian)訂(ding)勞(lao)(lao)動(dong)合(he)(he)同(tong)。
