試用期合同能否單獨簽?
問(wen) 現在(zai)還在(zai)試用期(qi),在(zai)試用期(qi)當中我可以跟用人單位(wei)單獨簽約嗎,勞動法有規定(ding)嗎?
答 《勞(lao)(lao)動(dong)合同(tong)法(fa)(fa)》第(di)(di)19條(tiao)第(di)(di)4款規定(ding):“試(shi)(shi)用期(qi)(qi)包含在勞(lao)(lao)動(dong)合同(tong)期(qi)(qi)限內。勞(lao)(lao)動(dong)合同(tong)僅約定(ding)試(shi)(shi)用期(qi)(qi)的(de)(de),試(shi)(shi)用期(qi)(qi)不(bu)成立,該期(qi)(qi)限為勞(lao)(lao)動(dong)合同(tong)期(qi)(qi)限。”第(di)(di)46條(tiao)第(di)(di)5項(xiang)(xiang)的(de)(de)規定(ding):除用人單位維持或者(zhe)提高勞(lao)(lao)動(dong)合同(tong)約定(ding)條(tiao)件續訂勞(lao)(lao)動(dong)合同(tong),勞(lao)(lao)動(dong)者(zhe)不(bu)同(tong)意續訂的(de)(de)情形外,依(yi)照本法(fa)(fa)第(di)(di)44條(tiao)第(di)(di)1項(xiang)(xiang)規定(ding)終止固定(ding)期(qi)(qi)限勞(lao)(lao)動(dong)合同(tong)的(de)(de),應支(zhi)付(fu)經濟補償(chang)。 其實是不(bu)能這么(me)做的(de)(de),如果這么(me)做,當企業要解除合同(tong)時,你往往得不(bu)到(dao)你應有的(de)(de)經濟賠償(chang)。
