單位收回勞動合同統一保管是否合理?
問 我(wo)是一(yi)名會計(ji)師,在濟南一(yi)家食品(pin)廠工作,最(zui)近公司把合同都收起來了,說是統一(yi)保管,這樣(yang)做合理嗎?
答 根據(ju)法律(lv)規定(ding),勞(lao)動(dong)(dong)(dong)合(he)(he)同(tong)文本由用人單(dan)位和勞(lao)動(dong)(dong)(dong)者(zhe)各執一份。因此,勞(lao)動(dong)(dong)(dong)合(he)(he)同(tong)文本應至少兩(liang)份。 目前有些(xie)單(dan)位在員(yuan)工簽訂勞(lao)動(dong)(dong)(dong)合(he)(he)同(tong)以(yi)后,將勞(lao)動(dong)(dong)(dong)合(he)(he)同(tong)收回,統一保管,是不符合(he)(he)法律(lv)規定(ding)的。 用人單(dan)位提供(gong)的勞(lao)動(dong)(dong)(dong)合(he)(he)同(tong)文本未載明本法規定(ding)的勞(lao)動(dong)(dong)(dong)合(he)(he)同(tong)必備(bei)條款,或者(zhe)用人單(dan)位未將勞(lao)動(dong)(dong)(dong)合(he)(he)同(tong)文本交(jiao)付勞(lao)動(dong)(dong)(dong)者(zhe)的,由勞(lao)動(dong)(dong)(dong)行政部(bu)門責令改(gai)正;給(gei)勞(lao)動(dong)(dong)(dong)者(zhe)造成損害的,應當承擔賠償責任。
