在試用期的懷孕女工公司可以辭退么?

首先,女(nv)性勞動(dong)(dong)(dong)者(zhe)在(zai)“三期(qi)”內(nei)哪怕是(shi)試(shi)用期(qi)也是(shi)受(shou)勞動(dong)(dong)(dong)法保(bao)護的(de),但(dan)是(shi)女(nv)性勞動(dong)(dong)(dong)者(zhe)在(zai)“三期(qi)”內(nei)在(zai)某些情(qing)況(kuang)下(xia)(xia)也是(shi)公司是(shi)可以解除(chu)勞動(dong)(dong)(dong)合(he)(he)同(tong)的(de),因(yin)為《中華人(ren)民共(gong)和國勞動(dong)(dong)(dong)法》第25條(tiao)同(tong)時(shi)也規定:“勞動(dong)(dong)(dong)者(zhe)有下(xia)(xia)列情(qing)形之一的(de),用人(ren)單(dan)(dan)位可以解除(chu)勞動(dong)(dong)(dong)合(he)(he)同(tong): (一)在(zai)試(shi)用期(qi)間被證明不符合(he)(he)錄用條(tiao)件(jian)的(de); (二)嚴重(zhong)(zhong)違(wei)反勞動(dong)(dong)(dong)紀律或者(zhe)用人(ren)單(dan)(dan)位規章(zhang)制度的(de); (三)嚴重(zhong)(zhong)失職,營私舞弊,對(dui)用人(ren)單(dan)(dan)位利益造成重(zhong)(zhong)大損害(hai)的(de); (四)被依(yi)法追究刑事(shi)責(ze)任的(de)。
