合同中對勞動報酬約定不清怎么辦?

答 《勞(lao)動(dong)(dong)合(he)同(tong)(tong)法》第18條(tiao)規(gui)(gui)定(ding)(ding)(ding):“勞(lao)動(dong)(dong)合(he)同(tong)(tong)對勞(lao)動(dong)(dong)報酬(chou)和勞(lao)動(dong)(dong)條(tiao)件等標準約定(ding)(ding)(ding)不明確,引發爭議的(de),用人(ren)單位(wei)與勞(lao)動(dong)(dong)者可(ke)以重新(xin)協商;協商不成的(de),適用集(ji)體(ti)合(he)同(tong)(tong)規(gui)(gui)定(ding)(ding)(ding);沒(mei)(mei)有(you)(you)集(ji)體(ti)合(he)同(tong)(tong)或者集(ji)體(ti)合(he)同(tong)(tong)未規(gui)(gui)定(ding)(ding)(ding)勞(lao)動(dong)(dong)報酬(chou)的(de),實行同(tong)(tong)工同(tong)(tong)酬(chou);沒(mei)(mei)有(you)(you)集(ji)體(ti)合(he)同(tong)(tong)或者集(ji)體(ti)合(he)同(tong)(tong)未規(gui)(gui)定(ding)(ding)(ding)勞(lao)動(dong)(dong)條(tiao)件等標準的(de),適用國(guo)家(jia)有(you)(you)關規(gui)(gui)定(ding)(ding)(ding)。”
