職工拒簽合同單位要付補償金么?

當初是員工(gong)自(zi)己(ji)拒簽的勞動合同(tong),想咨詢一下,職(zhi)工(gong)拒簽合同(tong)單位要付補償金么?

根據(ju)《勞(lao)動(dong)(dong)合(he)同法實(shi)施條例》第(di)5條規定,自(zi)用(yong)工之日(ri)起一個月內,經(jing)用(yong)人(ren)單(dan)位書面通(tong)(tong)知后(hou),勞(lao)動(dong)(dong)者(zhe)(zhe)不與(yu)用(yong)人(ren)單(dan)位訂(ding)立書面勞(lao)動(dong)(dong)合(he)同的,用(yong)人(ren)單(dan)位應當書面通(tong)(tong)知勞(lao)動(dong)(dong)者(zhe)(zhe)終(zhong)止勞(lao)動(dong)(dong)關(guan)系(xi),無需向勞(lao)動(dong)(dong)者(zhe)(zhe)支(zhi)付(fu)經(jing)濟補償,但是應當依法向勞(lao)動(dong)(dong)者(zhe)(zhe)支(zhi)付(fu)其(qi)實(shi)際工作時間的勞(lao)動(dong)(dong)報酬。
