(2)用(yong)(yong)(yong)(yong)人(ren)單(dan)(dan)(dan)位(wei)(wei)以(yi)(yi)暴(bao)力、威(wei)脅或者(zhe)(zhe)非(fei)(fei)(fei)法(fa)(fa)(fa)限(xian)制(zhi)人(ren)身(shen)(shen)自由(you)的(de)(de)(de)(de)(de)手段強(qiang)(qiang)迫(po)勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)(dong)的(de)(de)(de)(de)(de)。“暴(bao)力”是指對勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)實施捆綁、拉拽、毆(ou)打、傷害(hai)等行(xing)為。“威(wei)脅”是指對勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)施以(yi)(yi)暴(bao)力或者(zhe)(zhe)其(qi)他強(qiang)(qiang)迫(po)手段。人(ren)身(shen)(shen)自由(you)主要指公(gong)(gong)民(min)(min)(min)的(de)(de)(de)(de)(de)人(ren)身(shen)(shen)不(bu)受(shou)(shou)侵犯以(yi)(yi)及與此相關的(de)(de)(de)(de)(de)住宅和(he)(he)人(ren)格尊嚴不(bu)受(shou)(shou)侵犯等,它是公(gong)(gong)民(min)(min)(min)各種自由(you)權(quan)利當中(zhong)的(de)(de)(de)(de)(de)一(yi)種基本自由(you),是公(gong)(gong)民(min)(min)(min)參加社會活動(dong)(dong)(dong)(dong)(dong)(dong)(dong)和(he)(he)享受(shou)(shou)其(qi)他權(quan)利的(de)(de)(de)(de)(de)先決條件(jian)(jian)。我國公(gong)(gong)民(min)(min)(min)的(de)(de)(de)(de)(de)人(ren)身(shen)(shen)自由(you)受(shou)(shou)憲法(fa)(fa)(fa)和(he)(he)法(fa)(fa)(fa)律的(de)(de)(de)(de)(de)保護(hu),憲法(fa)(fa)(fa)第三十七條規(gui)(gui)定(ding)(ding)(ding):“中(zhong)華人(ren)民(min)(min)(min)共和(he)(he)國公(gong)(gong)民(min)(min)(min)的(de)(de)(de)(de)(de)人(ren)身(shen)(shen)自由(you)不(bu)受(shou)(shou)侵犯。任(ren)(ren)何公(gong)(gong)民(min)(min)(min),非(fei)(fei)(fei)經人(ren)民(min)(min)(min)檢察院(yuan)批準或者(zhe)(zhe)決定(ding)(ding)(ding)或者(zhe)(zhe)人(ren)民(min)(min)(min)法(fa)(fa)(fa)院(yuan)同(tong)(tong)意(yi),并由(you)公(gong)(gong)安機關執行(xing),不(bu)受(shou)(shou)逮捕(bu)。禁(jin)(jin)止非(fei)(fei)(fei)法(fa)(fa)(fa)拘禁(jin)(jin)和(he)(he)以(yi)(yi)其(qi)他方(fang)法(fa)(fa)(fa)剝奪(duo)或者(zhe)(zhe)限(xian)制(zhi)公(gong)(gong)民(min)(min)(min)的(de)(de)(de)(de)(de)人(ren)身(shen)(shen)自由(you)。”為了(le)落實上述(shu)權(quan)利,我國刑(xing)法(fa)(fa)(fa)、刑(xing)事訴訟法(fa)(fa)(fa)等嚴格規(gui)(gui)定(ding)(ding)(ding)了(le)逮捕(bu)、拘留人(ren)犯的(de)(de)(de)(de)(de)條件(jian)(jian)和(he)(he)程序。企(qi)業采取強(qiang)(qiang)迫(po)勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe),如(ru)(ru)把勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)非(fei)(fei)(fei)法(fa)(fa)(fa)拘禁(jin)(jin)在(zai)特(te)寫的(de)(de)(de)(de)(de)場所(suo),強(qiang)(qiang)迫(po)其(qi)勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)(dong),否則不(bu)讓(rang)他出(chu)來 ,是非(fei)(fei)(fei)法(fa)(fa)(fa)的(de)(de)(de)(de)(de),勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)有(you)(you)權(quan)隨時(shi)解(jie)(jie)除(chu)(chu)勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)(dong)合(he)(he)同(tong)(tong),并可(ke)以(yi)(yi)通過有(you)(you)關機關追究直接責任(ren)(ren)人(ren)的(de)(de)(de)(de)(de)責任(ren)(ren)。 (3)用(yong)(yong)(yong)(yong)人(ren)單(dan)(dan)(dan)位(wei)(wei)應盡的(de)(de)(de)(de)(de)義(yi)務。如(ru)(ru)果用(yong)(yong)(yong)(yong)人(ren)單(dan)(dan)(dan)位(wei)(wei)未按照國家規(gui)(gui)定(ding)(ding)(ding)的(de)(de)(de)(de)(de)標(biao)準或勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)(dong)合(he)(he)同(tong)(tong)的(de)(de)(de)(de)(de)規(gui)(gui)定(ding)(ding)(ding)提(ti)供勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)(dong)條件(jian)(jian),致(zhi)使(shi)勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)(dong)安全、勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)(dong)衛生(sheng)條件(jian)(jian)惡(e)劣(lie),嚴重危害(hai)職工的(de)(de)(de)(de)(de)身(shen)(shen)體健康,并得(de)到國家勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)(dong)部(bu)門、衛生(sheng)部(bu)門的(de)(de)(de)(de)(de)確認,勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)也(ye)(ye)有(you)(you)權(quan)提(ti)出(chu)解(jie)(jie)除(chu)(chu)勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)(dong)合(he)(he)同(tong)(tong)。
