上班一定要簽勞動合同嗎?

答 勞(lao)動(dong)(dong)(dong)合(he)同(tong)法第七條(tiao)規定(ding),用(yong)人單(dan)(dan)(dan)位(wei)自(zi)用(yong)工(gong)之(zhi)日(ri)起即與勞(lao)動(dong)(dong)(dong)者建立(li)勞(lao)動(dong)(dong)(dong)關系(xi)。第十條(tiao)規定(ding),建立(li)勞(lao)動(dong)(dong)(dong)關系(xi),應(ying)當訂(ding)(ding)立(li)書面勞(lao)動(dong)(dong)(dong)合(he)同(tong)。已建立(li)勞(lao)動(dong)(dong)(dong)關系(xi),未(wei)同(tong)時訂(ding)(ding)立(li)書面勞(lao)動(dong)(dong)(dong)合(he)同(tong)的,應(ying)當自(zi)用(yong)工(gong)之(zhi)日(ri)起一個(ge)月(yue)內訂(ding)(ding)立(li)書面勞(lao)動(dong)(dong)(dong)合(he)同(tong)。用(yong)人單(dan)(dan)(dan)位(wei)與勞(lao)動(dong)(dong)(dong)者在用(yong)工(gong)前訂(ding)(ding)立(li)勞(lao)動(dong)(dong)(dong)合(he)同(tong)的,勞(lao)動(dong)(dong)(dong)關系(xi)自(zi)用(yong)工(gong)之(zhi)日(ri)起建立(li)。所以畢業(ye)入職時應(ying)當與用(yong)人單(dan)(dan)(dan)位(wei)簽訂(ding)(ding)勞(lao)動(dong)(dong)(dong)合(he)同(tong),同(tong)時就業(ye)協議書已完成使命,自(zi)動(dong)(dong)(dong)失(shi)效。
