單位是否可以要求延長試用期?
問 我試用期(qi)一(yi)個月(yue),期(qi)滿了,公司(si)又要加一(yi)個月(yue),單位是否可以要求(qiu)延長試用期(qi)?
答 《勞動合同(tong)(tong)(tong)法》對試用(yong)(yong)期(qi)(qi)有這樣的(de)(de)限制:“勞動合同(tong)(tong)(tong)期(qi)(qi)限三個月(yue)(yue)以(yi)上不滿一(yi)年(nian)的(de)(de),試用(yong)(yong)期(qi)(qi)不得超過(guo)一(yi)個月(yue)(yue);勞動合同(tong)(tong)(tong)期(qi)(qi)限一(yi)年(nian)以(yi)上不滿三年(nian)的(de)(de),試用(yong)(yong)期(qi)(qi)不得超過(guo)二個月(yue)(yue);三年(nian)以(yi)上固定(ding)期(qi)(qi)限和(he)無(wu)固定(ding)期(qi)(qi)限的(de)(de)勞動合同(tong)(tong)(tong),試用(yong)(yong)期(qi)(qi)不得超過(guo)六個月(yue)(yue)。”簽訂勞動合同(tong)(tong)(tong)時,用(yong)(yong)工(gong)雙方(fang)可以(yi)約定(ding)不超過(guo)此標準的(de)(de)試用(yong)(yong)期(qi)(qi)。試用(yong)(yong)期(qi)(qi)結束前(qian),單位需要對員工(gong)進(jin)行評估,認為(wei)不合適的(de)(de),應該提出解除勞動合同(tong)(tong)(tong)。
