答 勞(lao)動(dong)(dong)合同法第9條規定(ding):用(yong)(yong)人單位招用(yong)(yong)勞(lao)動(dong)(dong)者(zhe),不得以(yi)其他名義(yi)向(xiang)勞(lao)動(dong)(dong)者(zhe)收(shou)取財物。所以(yi),收(shou)取工衣費、服(fu)裝(zhuang)費或工作服(fu)錢等做法,均是違反了該條規定(ding),勞(lao)動(dong)(dong)者(zhe)一旦(dan)向(xiang)勞(lao)動(dong)(dong)監察(cha)部門投訴,則必(bi)定(ding)被責令退回已收(shou)取的(de)費用(yong)(yong),并被處以(yi)每人500-2000元的(de)罰款(kuan)。勞(lao)動(dong)(dong)者(zhe)如(ru)果直接申請勞(lao)動(dong)(dong)仲裁(cai)(cai)的(de),則一定(ding)裁(cai)(cai)決勞(lao)動(dong)(dong)者(zhe)勝訴,裁(cai)(cai)決的(de)依據(ju)就是這一條。
