試用期合同能否單獨簽定?
問 我是個職場新(xin)人,現在在試用期(qi)期(qi)間,想咨詢一(yi)下,試用期(qi)合同能否單(dan)獨簽定?
答(da) 相關法規:《勞(lao)動(dong)合(he)同(tong)(tong)(tong)法》第(di)19條(tiao)第(di)4款規定(ding):“試(shi)用(yong)(yong)期(qi)包含在勞(lao)動(dong)合(he)同(tong)(tong)(tong)期(qi)限內(nei)。勞(lao)動(dong)合(he)同(tong)(tong)(tong)僅約(yue)(yue)定(ding)試(shi)用(yong)(yong)期(qi)的(de)(de),試(shi)用(yong)(yong)期(qi)不成立,該期(qi)限為勞(lao)動(dong)合(he)同(tong)(tong)(tong)期(qi)限。”第(di)46條(tiao)第(di)5項(xiang)的(de)(de)規定(ding):除用(yong)(yong)人單位維持或者提高勞(lao)動(dong)合(he)同(tong)(tong)(tong)約(yue)(yue)定(ding)條(tiao)件續(xu)訂(ding)勞(lao)動(dong)合(he)同(tong)(tong)(tong),勞(lao)動(dong)者不同(tong)(tong)(tong)意續(xu)訂(ding)的(de)(de)情形外,依照本法第(di)44條(tiao)第(di)1項(xiang)規定(ding)終止固(gu)定(ding)期(qi)限勞(lao)動(dong)合(he)同(tong)(tong)(tong)的(de)(de),應支付(fu)經濟補償。
