不簽勞動合同必賠兩倍工資嗎?

答 法(fa)律明確規定的(de)(de)(de)(de)是(shi)用(yong)人(ren)單位(wei)不依法(fa)與勞(lao)(lao)(lao)動(dong)(dong)者簽(qian)訂(ding)書(shu)面勞(lao)(lao)(lao)動(dong)(dong)合同(tong)(tong)(tong),才須承擔支付每月兩倍(bei)工(gong)資(zi)(zi)的(de)(de)(de)(de)法(fa)律責任,如(ru)果(guo)是(shi)由(you)于(yu)勞(lao)(lao)(lao)動(dong)(dong)者故意(yi)或不愿意(yi)與用(yong)人(ren)單位(wei)簽(qian)訂(ding)書(shu)面的(de)(de)(de)(de)勞(lao)(lao)(lao)動(dong)(dong)合同(tong)(tong)(tong)的(de)(de)(de)(de),則(ze)不適用(yong)于(yu)該條款(kuan)。因為新(xin)的(de)(de)(de)(de)《勞(lao)(lao)(lao)動(dong)(dong)合同(tong)(tong)(tong)法(fa)》立法(fa)的(de)(de)(de)(de)本意(yi)就(jiu)是(shi)要規范用(yong)人(ren)單位(wei)與勞(lao)(lao)(lao)動(dong)(dong)者簽(qian)訂(ding)書(shu)面的(de)(de)(de)(de)勞(lao)(lao)(lao)動(dong)(dong)合同(tong)(tong)(tong),保(bao)障勞(lao)(lao)(lao)動(dong)(dong)者的(de)(de)(de)(de)合法(fa)權益,并非給予勞(lao)(lao)(lao)動(dong)(dong)者不簽(qian)勞(lao)(lao)(lao)動(dong)(dong)合同(tong)(tong)(tong)便可(ke)(ke)得到雙倍(bei)工(gong)資(zi)(zi)的(de)(de)(de)(de)權利(li)。因此,如(ru)果(guo)員工(gong)故意(yi)或不愿意(yi)簽(qian)訂(ding)勞(lao)(lao)(lao)動(dong)(dong)合同(tong)(tong)(tong),則(ze)無權獲得兩倍(bei)工(gong)資(zi)(zi),而企業在這種情況(kuang)下可(ke)(ke)以解除勞(lao)(lao)(lao)動(dong)(dong)關系并且不用(yong)支付經濟補償金。
