曠工是否屬于解除勞動合同的法定事由?

曠工(gong)是(shi)(shi)職工(gong)在(zai)正常工(gong)作日不請假(jia)或請假(jia)未批準的缺勤(qin)行為(wei)。那么曠工(gong)是(shi)(shi)否屬于解(jie)除(chu)勞(lao)動合同的法(fa)定(ding)事由?

曠工并非(fei)是用(yong)人(ren)單(dan)位(wei)解除勞動(dong)(dong)合(he)同(tong)的法定(ding)(ding)事由(you),且通覽(lan)《勞動(dong)(dong)法》《勞動(dong)(dong)合(he)同(tong)法》及(ji)《最高(gao)人(ren)民法院關(guan)于審理勞動(dong)(dong)爭(zheng)議案件適用(yong)法律若干問題的解釋(shi)》,都未有與曠工相關(guan)的條文規(gui)定(ding)(ding)和表(biao)述(shu)。只是散見(jian)于《公(gong)務(wu)(wu)員(yuan)(yuan)法》第(di)83條規(gui)定(ding)(ding):(公(gong)務(wu)(wu)員(yuan)(yuan)辭退(tui)法定(ding)(ding)事由(you))“(五)曠工或因公(gong)外出,請假期滿無正當理由(you)逾期不歸連續超(chao)(chao)過15天或者一年內累計超(chao)(chao)過三十天的。”及(ji)《行政(zheng)機關(guan)公(gong)務(wu)(wu)員(yuan)(yuan)處分條例》第(di)十九(jiu)條規(gui)定(ding)(ding):(給予處分的情形)
