1.勞(lao)動(dong)(dong)(dong)(dong)者在該用(yong)(yong)人(ren)單(dan)位(wei)(wei)(wei)連續工(gong)作(zuo)滿十(shi)(shi)(shi)年(nian)的(de); 2.用(yong)(yong)人(ren)單(dan)位(wei)(wei)(wei)初次(ci)實行勞(lao)動(dong)(dong)(dong)(dong)合(he)同制度或者國有(you)企業改制重新訂立勞(lao)動(dong)(dong)(dong)(dong)合(he)同時,勞(lao)動(dong)(dong)(dong)(dong)者在該用(yong)(yong)人(ren)單(dan)位(wei)(wei)(wei)連續工(gong)作(zuo)滿十(shi)(shi)(shi)年(nian)且(qie)距法定退休年(nian)齡不足十(shi)(shi)(shi)年(nian)的(de); 3.連續訂立二次(ci)固定期(qi)限(xian)勞(lao)動(dong)(dong)(dong)(dong)合(he)同,且(qie)勞(lao)動(dong)(dong)(dong)(dong)者沒有(you)本(ben)法第(di)三十(shi)(shi)(shi)九條(tiao)和第(di)四十(shi)(shi)(shi)條(tiao)第(di)一(yi)項、第(di)二項規(gui)定的(de)情形,續訂勞(lao)動(dong)(dong)(dong)(dong)合(he)同的(de)。 用(yong)(yong)人(ren)單(dan)位(wei)(wei)(wei)自用(yong)(yong)工(gong)之(zhi)日起滿一(yi)年(nian)不與勞(lao)動(dong)(dong)(dong)(dong)者訂立書面勞(lao)動(dong)(dong)(dong)(dong)合(he)同的(de),視為用(yong)(yong)人(ren)單(dan)位(wei)(wei)(wei)與勞(lao)動(dong)(dong)(dong)(dong)者已訂立無固定期(qi)限(xian)勞(lao)動(dong)(dong)(dong)(dong)合(he)同。
