勞(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)(tong)法》規定:“勞(lao)(lao)動(dong)(dong)者(zhe)提前(qian)30日(ri)以(yi)書面形式通(tong)知用(yong)人(ren)單(dan)位(wei),可以(yi)解除(chu)勞(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)(tong)。勞(lao)(lao)動(dong)(dong)者(zhe)在(zai)試用(yong)期(qi)(qi)內提前(qian)3日(ri)通(tong)知用(yong)人(ren)單(dan)位(wei),可以(yi)解除(chu)勞(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)(tong)。”第(di)二十(shi)條(tiao) 勞(lao)(lao)動(dong)(dong)者(zhe)在(zai)試用(yong)期(qi)(qi)的(de)(de)工(gong)資(zi)不得(de)低(di)(di)于本單(dan)位(wei)相同(tong)(tong)(tong)崗位(wei)最(zui)低(di)(di)檔工(gong)資(zi)或者(zhe)勞(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)(tong)約定工(gong)資(zi)的(de)(de)百分之八十(shi),并不得(de)低(di)(di)于用(yong)人(ren)單(dan)位(wei)所在(zai)地的(de)(de)最(zui)低(di)(di)工(gong)資(zi)標(biao)準(zhun)。第(di)二十(shi)一(yi)條(tiao) 在(zai)試用(yong)期(qi)(qi)中,除(chu)勞(lao)(lao)動(dong)(dong)者(zhe)有本法第(di)三十(shi)九條(tiao)和第(di)四(si)十(shi)條(tiao)第(di)一(yi)項、第(di)二項規定的(de)(de)情形外,用(yong)人(ren)單(dan)位(wei)不得(de)解除(chu)勞(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)(tong)。用(yong)人(ren)單(dan)位(wei)在(zai)試用(yong)期(qi)(qi)解除(chu)勞(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)(tong)的(de)(de),應當(dang)向勞(lao)(lao)動(dong)(dong)者(zhe)說明理由。
