勞動合同無效怎么處理?

最近(jin)我發現跟公司簽訂的合(he)同(tong)不合(he)法,想咨詢一下,勞動(dong)合(he)同(tong)無效(xiao)怎么處理?

答(da) 《勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合(he)(he)同(tong)法(fa)》第(di)(di)三十九條規定:“勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者有下列情形之一(yi)的,用人(ren)單位可(ke)(ke)以(yi)解(jie)除勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合(he)(he)同(tong):……(五)因(yin)本法(fa)第(di)(di)二十六(liu)條第(di)(di)一(yi)款第(di)(di)一(yi)項規定的情形致(zhi)使勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合(he)(he)同(tong)無效的;……。”用人(ren)單位認為勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者確(que)實以(yi)欺詐(zha)手段使單位違背真(zhen)實意(yi)思(si)簽訂了勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合(he)(he)同(tong)的,可(ke)(ke)以(yi)立即解(jie)除雙(shuang)方的勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合(he)(he)同(tong)。結合(he)(he)《勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合(he)(he)同(tong)法(fa)》第(di)(di)四(si)十六(liu)條有關(guan)經(jing)濟(ji)補(bu)償金的規定可(ke)(ke)以(yi)發現,因(yin)為勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者原(yuan)因(yin)致(zhi)使勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合(he)(he)同(tong)無效而解(jie)除勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合(he)(he)同(tong)的,單位不需(xu)要支付任何經(jing)濟(ji)補(bu)償金。
