勞動合同無效怎么處理?

最近我發現(xian)跟公司簽訂的合同不合法,想咨詢一下(xia),勞(lao)動(dong)合同無效怎么(me)處(chu)理?

答(da) 《勞(lao)動(dong)(dong)合(he)(he)同(tong)(tong)法(fa)》第(di)三十(shi)(shi)九條規(gui)定:“勞(lao)動(dong)(dong)者有(you)下列情形(xing)之一(yi)的(de)(de)(de),用人單(dan)位(wei)可(ke)以(yi)解除(chu)勞(lao)動(dong)(dong)合(he)(he)同(tong)(tong):……(五(wu))因本法(fa)第(di)二十(shi)(shi)六條第(di)一(yi)款第(di)一(yi)項規(gui)定的(de)(de)(de)情形(xing)致使勞(lao)動(dong)(dong)合(he)(he)同(tong)(tong)無效的(de)(de)(de);……。”用人單(dan)位(wei)認為勞(lao)動(dong)(dong)者確實以(yi)欺詐手段使單(dan)位(wei)違背真(zhen)實意思(si)簽(qian)訂了勞(lao)動(dong)(dong)合(he)(he)同(tong)(tong)的(de)(de)(de),可(ke)以(yi)立即解除(chu)雙方的(de)(de)(de)勞(lao)動(dong)(dong)合(he)(he)同(tong)(tong)。結(jie)合(he)(he)《勞(lao)動(dong)(dong)合(he)(he)同(tong)(tong)法(fa)》第(di)四(si)十(shi)(shi)六條有(you)關經濟補償金的(de)(de)(de)規(gui)定可(ke)以(yi)發現,因為勞(lao)動(dong)(dong)者原因致使勞(lao)動(dong)(dong)合(he)(he)同(tong)(tong)無效而解除(chu)勞(lao)動(dong)(dong)合(he)(he)同(tong)(tong)的(de)(de)(de),單(dan)位(wei)不需要支付任(ren)何經濟補償金。
