《勞(lao)(lao)動(dong)(dong)合(he)(he)同(tong)法(fa)》沒有規(gui)定(ding)勞(lao)(lao)動(dong)(dong)合(he)(he)同(tong)的(de)期(qi)限(xian)(xian)(xian),由勞(lao)(lao)動(dong)(dong)者和用人(ren)單(dan)(dan)位(wei)(wei)協(xie)商確(que)定(ding),可以(yi)簽訂(ding)固定(ding)期(qi)勞(lao)(lao)動(dong)(dong)合(he)(he)同(tong)也可以(yi)簽訂(ding)無固定(ding)期(qi)限(xian)(xian)(xian)勞(lao)(lao)動(dong)(dong)合(he)(he)同(tong),勞(lao)(lao)務(wu)派(pai)(pai)(pai)遣(qian)單(dan)(dan)位(wei)(wei)是本法(fa)所稱用人(ren)單(dan)(dan)位(wei)(wei),應當履行用人(ren)單(dan)(dan)位(wei)(wei)對勞(lao)(lao)動(dong)(dong)者的(de)義務(wu)。勞(lao)(lao)務(wu)派(pai)(pai)(pai)遣(qian)單(dan)(dan)位(wei)(wei)與被派(pai)(pai)(pai)遣(qian)勞(lao)(lao)動(dong)(dong)者訂(ding)立(li)的(de)勞(lao)(lao)動(dong)(dong)合(he)(he)同(tong),除應當載明本法(fa)第十(shi)七條規(gui)定(ding)的(de)事項外,還應當載明被派(pai)(pai)(pai)遣(qian)勞(lao)(lao)動(dong)(dong)者的(de)用工單(dan)(dan)位(wei)(wei)以(yi)及(ji)派(pai)(pai)(pai)遣(qian)期(qi)限(xian)(xian)(xian)、工作(zuo)崗位(wei)(wei)等情(qing)況。勞(lao)(lao)務(wu)派(pai)(pai)(pai)遣(qian)單(dan)(dan)位(wei)(wei)應當與被派(pai)(pai)(pai)遣(qian)勞(lao)(lao)動(dong)(dong)者訂(ding)立(li)二(er)年以(yi)上的(de)固定(ding)期(qi)限(xian)(xian)(xian)勞(lao)(lao)動(dong)(dong)合(he)(he)同(tong),按(an)(an)月支付(fu)勞(lao)(lao)動(dong)(dong)報(bao)酬;被派(pai)(pai)(pai)遣(qian)勞(lao)(lao)動(dong)(dong)者在無工作(zuo)期(qi)間,勞(lao)(lao)務(wu)派(pai)(pai)(pai)遣(qian)單(dan)(dan)位(wei)(wei)應當按(an)(an)照所在地(di)人(ren)民政府(fu)規(gui)定(ding)的(de)最低(di)工資(zi)標準,向其按(an)(an)月支付(fu)報(bao)酬。
