女職工(gong)(gong)在(zai)哺乳期間,用人單位解除勞(lao)(lao)(lao)動(dong)(dong)合同的(de),用人單位必須支(zhi)(zhi)(zhi)付給勞(lao)(lao)(lao)動(dong)(dong)者(zhe)(zhe)經(jing)(jing)(jing)濟(ji)補(bu)償(chang)(chang)金。經(jing)(jing)(jing)濟(ji)補(bu)償(chang)(chang)按勞(lao)(lao)(lao)動(dong)(dong)者(zhe)(zhe)在(zai)本(ben)單位工(gong)(gong)作的(de)年(nian)限,每滿一(yi)年(nian)支(zhi)(zhi)(zhi)付一(yi)個(ge)(ge)月(yue)(yue)(yue)工(gong)(gong)資(zi)(zi)(zi)的(de)標(biao)準(zhun)向勞(lao)(lao)(lao)動(dong)(dong)者(zhe)(zhe)支(zhi)(zhi)(zhi)付。六個(ge)(ge)月(yue)(yue)(yue)以(yi)上不(bu)滿一(yi)年(nian)的(de),按一(yi)年(nian)計算;不(bu)滿六個(ge)(ge)月(yue)(yue)(yue)的(de),向勞(lao)(lao)(lao)動(dong)(dong)者(zhe)(zhe)支(zhi)(zhi)(zhi)付半個(ge)(ge)月(yue)(yue)(yue)工(gong)(gong)資(zi)(zi)(zi)的(de)經(jing)(jing)(jing)濟(ji)補(bu)償(chang)(chang)。勞(lao)(lao)(lao)動(dong)(dong)者(zhe)(zhe)月(yue)(yue)(yue)工(gong)(gong)資(zi)(zi)(zi)高(gao)于(yu)用人單位所在(zai)直轄市(shi)、設區(qu)的(de)市(shi)級人民政府公布(bu)的(de)本(ben)地區(qu)上年(nian)度職工(gong)(gong)月(yue)(yue)(yue)平均(jun)工(gong)(gong)資(zi)(zi)(zi)三(san)倍的(de),向其(qi)支(zhi)(zhi)(zhi)付經(jing)(jing)(jing)濟(ji)補(bu)償(chang)(chang)的(de)標(biao)準(zhun)按職工(gong)(gong)月(yue)(yue)(yue)平均(jun)工(gong)(gong)資(zi)(zi)(zi)三(san)倍的(de)數額(e)支(zhi)(zhi)(zhi)付,向其(qi)支(zhi)(zhi)(zhi)付經(jing)(jing)(jing)濟(ji)補(bu)償(chang)(chang)的(de)年(nian)限最(zui)高(gao)不(bu)超過十(shi)二(er)年(nian)。所稱月(yue)(yue)(yue)工(gong)(gong)資(zi)(zi)(zi)是指勞(lao)(lao)(lao)動(dong)(dong)者(zhe)(zhe)在(zai)勞(lao)(lao)(lao)動(dong)(dong)合同解除或者(zhe)(zhe)終(zhong)止前十(shi)二(er)個(ge)(ge)月(yue)(yue)(yue)的(de)平均(jun)工(gong)(gong)資(zi)(zi)(zi)。
