單位與勞動者簽試用合同違法嗎?

答(da) 依據《勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)法(fa)(fa)(fa)》第十(shi)六條第二款的(de)規定(ding)(ding):“建立勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)關系應當訂立勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)同(tong)(tong)(tong)(tong)。”和(he)(he)《勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)法(fa)(fa)(fa)》第二十(shi)一條規定(ding)(ding):“勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)同(tong)(tong)(tong)(tong)可(ke)以(yi)(yi)約(yue)定(ding)(ding)試用(yong)期。試用(yong)期最長不(bu)得(de)超過6個月。”根據上述規定(ding)(ding),勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)和(he)(he)用(yong)人(ren)(ren)(ren)單(dan)(dan)位(wei)(wei)建立勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)關系,就應當簽訂勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)同(tong)(tong)(tong)(tong)。對(dui)于新上崗的(de)勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe),用(yong)人(ren)(ren)(ren)單(dan)(dan)位(wei)(wei)與勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)可(ke)以(yi)(yi)約(yue)定(ding)(ding)試用(yong)期也可(ke)以(yi)(yi)不(bu)約(yue)定(ding)(ding)試用(yong)期。如(ru)果(guo)用(yong)人(ren)(ren)(ren)單(dan)(dan)位(wei)(wei)與勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)約(yue)定(ding)(ding)試用(yong)期,試用(yong)期應在勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)同(tong)(tong)(tong)(tong)中約(yue)定(ding)(ding)。簽訂勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)同(tong)(tong)(tong)(tong),如(ru)果(guo)發生(sheng)勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)爭議,在申請(qing)勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)爭議仲(zhong)裁(cai)時(shi),有利于維(wei)護(hu)勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)和(he)(he)用(yong)人(ren)(ren)(ren)單(dan)(dan)位(wei)(wei)雙方的(de)合(he)法(fa)(fa)(fa)權益。用(yong)人(ren)(ren)(ren)單(dan)(dan)位(wei)(wei)將試用(yong)期與勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)同(tong)(tong)(tong)(tong)分開(kai)的(de)這種做法(fa)(fa)(fa)是(shi)錯誤的(de),是(shi)違反(fan)《勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)法(fa)(fa)(fa)》的(de),只是(shi)約(yue)定(ding)(ding)試用(yong)期而沒有約(yue)定(ding)(ding)合(he)同(tong)(tong)(tong)(tong)期的(de),試用(yong)期無效,視為正(zheng)式勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)同(tong)(tong)(tong)(tong)。許多人(ren)(ren)(ren)尤其(qi)是(shi)剛畢業的(de)大學(xue)生(sheng)對(dui)《勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)法(fa)(fa)(fa)》不(bu)太了解,應該特別注意。
