單位與勞動者簽試用合同違法嗎?

知道大(da)家有沒有遇(yu)到過這樣的(de)情況:單位在您入職(zhi)后,并不是與(yu)(yu)您簽訂(ding)正式的(de)勞(lao)動合同(tong),而只是簽訂(ding)試用(yong)合同(tong),單位與(yu)(yu)勞(lao)動者簽試用(yong)合同(tong)違法嗎?

依據《勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)法(fa)》第十六條第二(er)款的(de)規定(ding)(ding)(ding):“建立勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)關系(xi)應當訂立勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合同(tong)。”和《勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)法(fa)》第二(er)十一條規定(ding)(ding)(ding):“勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合同(tong)可(ke)以(yi)約(yue)定(ding)(ding)(ding)試(shi)用(yong)期(qi)(qi)。試(shi)用(yong)期(qi)(qi)最(zui)長(chang)不得超過6個月(yue)。”根據上述規定(ding)(ding)(ding),勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者和用(yong)人(ren)(ren)單(dan)位(wei)(wei)建立勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)關系(xi),就應當簽(qian)訂勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合同(tong)。對于新上崗的(de)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者,用(yong)人(ren)(ren)單(dan)位(wei)(wei)與(yu)(yu)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者可(ke)以(yi)約(yue)定(ding)(ding)(ding)試(shi)用(yong)期(qi)(qi)也(ye)可(ke)以(yi)不約(yue)定(ding)(ding)(ding)試(shi)用(yong)期(qi)(qi)。如果(guo)用(yong)人(ren)(ren)單(dan)位(wei)(wei)與(yu)(yu)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者約(yue)定(ding)(ding)(ding)試(shi)用(yong)期(qi)(qi),試(shi)用(yong)期(qi)(qi)應在(zai)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合同(tong)中約(yue)定(ding)(ding)(ding)。簽(qian)訂勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合同(tong),如果(guo)發生勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)爭(zheng)(zheng)議,在(zai)申(shen)請勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)爭(zheng)(zheng)議仲(zhong)裁時(shi),有(you)利于維(wei)護勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者和用(yong)人(ren)(ren)單(dan)位(wei)(wei)雙(shuang)方的(de)合法(fa)權益。用(yong)人(ren)(ren)單(dan)位(wei)(wei)將試(shi)用(yong)期(qi)(qi)與(yu)(yu)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合同(tong)分開的(de)這種(zhong)做法(fa)是(shi)錯誤的(de),是(shi)違反《勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)法(fa)》的(de),只是(shi)約(yue)定(ding)(ding)(ding)試(shi)用(yong)期(qi)(qi)而(er)沒有(you)約(yue)定(ding)(ding)(ding)合同(tong)期(qi)(qi)的(de),試(shi)用(yong)期(qi)(qi)無效,視(shi)為正式勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合同(tong)。許多(duo)人(ren)(ren)尤其是(shi)剛畢業的(de)大學(xue)生對《勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)法(fa)》不太了解,應該特別注意。
