沒有簽訂勞動合同有試用期嗎?

實踐中有(you)的用(yong)人單(dan)位(wei)為逃避對員工(gong)的義(yi)務,在(zai)建立了用(yong)工(gong)關(guan)系之后,也沒有(you)按照規定與員工(gong)實際簽訂(ding)書面(mian)的勞(lao)動(dong)合同,沒有(you)簽訂(ding)勞(lao)動(dong)合同有(you)試用(yong)期嗎(ma)?

《勞(lao)動(dong)(dong)(dong)部(bu)(bu)關(guan)于(yu)實行(xing)勞(lao)動(dong)(dong)(dong)合(he)(he)同制度若干問題的(de)通知(zhi)》中(zhong)明確說:“試用(yong)期(qi)(qi)包括(kuo)在勞(lao)動(dong)(dong)(dong)合(he)(he)同期(qi)(qi)限(xian)(xian)中(zhong)。”《勞(lao)動(dong)(dong)(dong)部(bu)(bu)關(guan)于(yu)印發〈關(guan)于(yu)貫徹執(zhi)行(xing)《中(zhong)華人民共(gong)和國勞(lao)動(dong)(dong)(dong)法(fa)》若干問題的(de)意見〉的(de)通知(zhi)》中(zhong)也(ye)表(biao)示:“勞(lao)動(dong)(dong)(dong)者(zhe)被用(yong)人單位錄用(yong)后,雙方可以(yi)在勞(lao)動(dong)(dong)(dong)合(he)(he)同中(zhong)的(de)約定試用(yong)期(qi)(qi),試用(yong)期(qi)(qi)應包括(kuo)在勞(lao)動(dong)(dong)(dong)合(he)(he)同期(qi)(qi)限(xian)(xian)內。”所(suo)有(you)其(qi)他的(de)關(guan)于(yu)試用(yong)期(qi)(qi)的(de)法(fa)律(lv)條文也(ye)是就試用(yong)期(qi)(qi)在勞(lao)動(dong)(dong)(dong)合(he)(he)同期(qi)(qi)限(xian)(xian)中(zhong)的(de)情(qing)況來(lai)規定的(de)。比(bi)如“勞(lao)動(dong)(dong)(dong)合(he)(he)同期(qi)(qi)限(xian)(xian)在六(liu)個月以(yi)下的(de),試用(yong)期(qi)(qi)不得超過十五日(ri)”等等。可以(yi)說試用(yong)期(qi)(qi)是兒子,勞(lao)動(dong)(dong)(dong)合(he)(he)同是母親(qin),沒(mei)有(you)母親(qin)哪里(li)來(lai)的(de)兒子呢!在事實已經發生的(de)情(qing)況下,很顯(xian)然,沒(mei)有(you)勞(lao)動(dong)(dong)(dong)合(he)(he)同,試用(yong)期(qi)(qi)的(de)說法(fa)就不能成立。
