答(da) (一(yi)(yi))原(yuan)則《勞(lao)(lao)動(dong)合(he)(he)同(tong)(tong)(tong)法(fa)(fa)》第三條規定(ding):訂(ding)立(li)勞(lao)(lao)動(dong)合(he)(he)同(tong)(tong)(tong),應當(dang)遵循合(he)(he)法(fa)(fa)、公(gong)平、平等自(zi)愿、協商一(yi)(yi)致、誠實信用(yong)的(de)原(yuan)則。依(yi)法(fa)(fa)訂(ding)立(li)的(de)勞(lao)(lao)動(dong)合(he)(he)同(tong)(tong)(tong)具有約束力,用(yong)人單(dan)位(wei)(wei)與勞(lao)(lao)動(dong)者(zhe)(zhe)應當(dang)履(lv)行(xing)勞(lao)(lao)動(dong)合(he)(he)同(tong)(tong)(tong)規定(ding)的(de)義務。 (二)簽(qian)訂(ding)勞(lao)(lao)動(dong)合(he)(he)同(tong)(tong)(tong)由用(yong)人單(dan)位(wei)(wei)與勞(lao)(lao)動(dong)者(zhe)(zhe)協商一(yi)(yi)致,并經用(yong)人單(dan)位(wei)(wei)與勞(lao)(lao)動(dong)者(zhe)(zhe)在勞(lao)(lao)動(dong)合(he)(he)同(tong)(tong)(tong)文(wen)本上簽(qian)字或者(zhe)(zhe)蓋(gai)章生效。勞(lao)(lao)動(dong)合(he)(he)同(tong)(tong)(tong)文(wen)本由用(yong)人單(dan)位(wei)(wei)和勞(lao)(lao)動(dong)者(zhe)(zhe)各執一(yi)(yi)份。
