(一(yi))原(yuan)則《勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合(he)(he)同(tong)(tong)法(fa)》第三(san)條(tiao)規定(ding):訂(ding)立勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合(he)(he)同(tong)(tong),應當遵循合(he)(he)法(fa)、公(gong)平(ping)、平(ping)等自愿、協(xie)商一(yi)致、誠(cheng)實信用(yong)(yong)的(de)原(yuan)則。依法(fa)訂(ding)立的(de)勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合(he)(he)同(tong)(tong)具有約束(shu)力,用(yong)(yong)人(ren)單(dan)位(wei)與(yu)(yu)勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)(zhe)應當履行勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合(he)(he)同(tong)(tong)規定(ding)的(de)義(yi)務。 (二)簽訂(ding)勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合(he)(he)同(tong)(tong)由用(yong)(yong)人(ren)單(dan)位(wei)與(yu)(yu)勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)(zhe)協(xie)商一(yi)致,并經用(yong)(yong)人(ren)單(dan)位(wei)與(yu)(yu)勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)(zhe)在勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合(he)(he)同(tong)(tong)文(wen)本(ben)上簽字或者(zhe)(zhe)(zhe)蓋章生效。勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合(he)(he)同(tong)(tong)文(wen)本(ben)由用(yong)(yong)人(ren)單(dan)位(wei)和(he)勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)(zhe)各執一(yi)份。
