服務期超過勞動合同期限怎么辦?

問 勞動(dong)合(he)同(tong)(tong)期(qi)限(xian)是(shi)(shi)勞動(dong)合(he)同(tong)(tong)確定的,用人單(dan)位(wei)與勞動(dong)者享有(you)、履(lv)行各自勞動(dong)權利義務(wu)關系的期(qi)限(xian),但是(shi)(shi)服務(wu)期(qi)超過(guo)勞動(dong)合(he)同(tong)(tong)期(qi)限(xian)怎么辦?
答 根據《中(zhong)華人民共(gong)和國勞動(dong)合同法實施條例(li)》第17條的規定(ding):“勞動(dong)合同期(qi)滿(man),但是(shi)用人單位與勞動(dong)者(zhe)約定(ding)的服務期(qi)尚未(wei)到期(qi)的,勞動(dong)合同應(ying)當續延至服務期(qi)滿(man);雙方另(ling)有(you)約定(ding)的,從其約定(ding)。”因此,除(chu)非當事人另(ling)有(you)約定(ding),否則,勞動(dong)合同期(qi)限應(ying)順延至服務期(qi)滿(man)。
