補簽勞動合同需支付雙倍工資嗎?

勞(lao)動法(fa)規定用(yong)人單(dan)位必(bi)須和勞(lao)動者在(zai)用(yong)工期簽(qian)訂勞(lao)動合同(tong)(tong)(tong),沒有(you)簽(qian)訂勞(lao)動合同(tong)(tong)(tong),用(yong)人單(dan)位是需要(yao)承擔雙(shuang)倍工資的(de),如果用(yong)人單(dan)位補簽(qian)勞(lao)動合同(tong)(tong)(tong)的(de)日期有(you)什么(me)要(yao)求呢?

“兩倍工(gong)資”和“補訂合(he)(he)(he)(he)同”是用(yong)(yong)人(ren)單位并列承擔的(de)責任,即使補訂書(shu)面勞(lao)(lao)動(dong)(dong)(dong)合(he)(he)(he)(he)同,仍應(ying)(ying)支付勞(lao)(lao)動(dong)(dong)(dong)者兩倍工(gong)資。根據我國《勞(lao)(lao)動(dong)(dong)(dong)合(he)(he)(he)(he)同法(fa)》第(di)10條規定:已(yi)建立(li)勞(lao)(lao)動(dong)(dong)(dong)關(guan)系,未同時訂立(li)書(shu)面勞(lao)(lao)動(dong)(dong)(dong)合(he)(he)(he)(he)同的(de),應(ying)(ying)當自(zi)用(yong)(yong)工(gong)之日起一個月內(nei)訂立(li)書(shu)面勞(lao)(lao)動(dong)(dong)(dong)合(he)(he)(he)(he)同。用(yong)(yong)人(ren)單位與勞(lao)(lao)動(dong)(dong)(dong)者在用(yong)(yong)工(gong)前訂立(li)勞(lao)(lao)動(dong)(dong)(dong)合(he)(he)(he)(he)同的(de),勞(lao)(lao)動(dong)(dong)(dong)關(guan)系自(zi)用(yong)(yong)工(gong)之日起建立(li)。
