試用期員工不勝任工作的能辭退嗎?

答 相關(guan)法(fa)規:《勞(lao)(lao)動(dong)(dong)合同(tong)(tong)法(fa)》第(di)三十九條 勞(lao)(lao)動(dong)(dong)者(zhe)(zhe)(zhe)有下列(lie)情形(xing)之一的,用(yong)(yong)人(ren)單(dan)位(wei)(wei)可以解除(chu)(chu)勞(lao)(lao)動(dong)(dong)合同(tong)(tong):(一)在試用(yong)(yong)期(qi)間被證明(ming)不符合錄用(yong)(yong)條件的。第(di)四十條 有下列(lie)情形(xing)之一的,用(yong)(yong)人(ren)單(dan)位(wei)(wei)提前三十日以書面形(xing)式通(tong)知勞(lao)(lao)動(dong)(dong)者(zhe)(zhe)(zhe)本人(ren)或者(zhe)(zhe)(zhe)額外支付勞(lao)(lao)動(dong)(dong)者(zhe)(zhe)(zhe)一個月工(gong)資后,可以解除(chu)(chu)勞(lao)(lao)動(dong)(dong)合同(tong)(tong)。(二)勞(lao)(lao)動(dong)(dong)者(zhe)(zhe)(zhe)不能(neng)勝任工(gong)作(zuo),經過培訓或者(zhe)(zhe)(zhe)調整工(gong)作(zuo)崗位(wei)(wei),仍不能(neng)勝任工(gong)作(zuo)的。
