企業能否單方面變更員工的工作崗位?

我是個職場新人,現在想咨詢一下,請問企業能否單方面變更員工(gong)(gong)的工(gong)(gong)作崗位(wei)?

答(da) 變更(geng)工作崗位屬于(yu)對勞(lao)動(dong)(dong)合同(tong)(tong)(tong)的變更(geng),但根據《勞(lao)動(dong)(dong)法》有關規(gui)定:勞(lao)動(dong)(dong)合同(tong)(tong)(tong)訂立時所(suo)依(yi)據的客(ke)觀情況發生(sheng)重大變化(hua),致(zhi)使(shi)原勞(lao)動(dong)(dong)合同(tong)(tong)(tong)無法履行,用(yong)人單位仍然必須履行與勞(lao)動(dong)(dong)者(zhe)協商(shang)(shang)變更(geng)勞(lao)動(dong)(dong)合同(tong)(tong)(tong)的法定程序(xu),經(jing)當(dang)事人協商(shang)(shang)不能就變更(geng)勞(lao)動(dong)(dong)合同(tong)(tong)(tong)達成協議的用(yong)人單位可(ke)以(yi)解(jie)除勞(lao)動(dong)(dong)合同(tong)(tong)(tong),但是應當(dang)提前30日以(yi)書面的形式通知勞(lao)動(dong)(dong)者(zhe)本人。
