員工自愿不買社保HR該怎么辦?

答 我國《勞(lao)動法(fa)(fa)》規(gui)定(ding)(ding),用(yong)人單位和勞(lao)動者必(bi)須依法(fa)(fa)參加社(she)會(hui)保(bao)險(xian)(xian),繳(jiao)納社(she)會(hui)保(bao)險(xian)(xian)費。從法(fa)(fa)律(lv)的規(gui)定(ding)(ding)可以看出,社(she)會(hui)保(bao)險(xian)(xian)是國家強制保(bao)險(xian)(xian),為(wei)職工辦理(li)社(she)會(hui)保(bao)險(xian)(xian)是用(yong)人單位的法(fa)(fa)定(ding)(ding)義(yi)務(wu),即使勞(lao)動者主動提出要求(qiu)也(ye)不(bu)能免除用(yong)人單位為(wei)職工參加社(she)會(hui)保(bao)險(xian)(xian)的法(fa)(fa)定(ding)(ding)義(yi)務(wu)。勞(lao)動者雖主動要求(qiu)用(yong)人單位不(bu)為(wei)其(qi)參加社(she)會(hui)保(bao)險(xian)(xian),并(bing)作出書面承諾,但會(hui)有最終(zhong)會(hui)被認定(ding)(ding)為(wei)無(wu)效的風險(xian)(xian),《民法(fa)(fa)通則》也(ye)明確(que)規(gui)定(ding)(ding)違反法(fa)(fa)律(lv)或者社(she)會(hui)公(gong)共利益的民事行為(wei)無(wu)效。
