答 《勞(lao)動合同(tong)法》第(di)八十二條的(de)(de)處罰:“用(yong)人單位自用(yong)工(gong)(gong)之日起超(chao)過(guo)一個月(yue)(yue)不(bu)滿一年未(wei)與勞(lao)動者訂(ding)立書面(mian)勞(lao)動合同(tong)的(de)(de),應當向勞(lao)動者每月(yue)(yue)支付(fu)二倍的(de)(de)工(gong)(gong)資。”所(suo)以,開始工(gong)(gong)作(zuo)一個月(yue)(yue)內不(bu)簽(qian)(qian)訂(ding)勞(lao)動合同(tong),是(shi)法律允(yun)許的(de)(de)。但是(shi)超(chao)過(guo)一個月(yue)(yue)還不(bu)簽(qian)(qian)訂(ding),就(jiu)要(yao)給(gei)予兩(liang)倍工(gong)(gong)資。兩(liang)倍工(gong)(gong)資從工(gong)(gong)作(zuo)第(di)二個月(yue)(yue)開始給(gei)。
