試用期內單位能否隨時辭退員工?

我是個職場(chang)新人,現在想咨詢一下,請問試用期內單(dan)位能否隨時(shi)辭(ci)退員工(gong)?

根據(ju)《勞動(dong)(dong)法》第(di)二十五條(tiao)規定,勞動(dong)(dong)者(zhe)在試(shi)用(yong)期間(jian)(jian)被(bei)證(zheng)(zheng)明不(bu)符合(he)(he)錄用(yong)條(tiao)件的(de),用(yong)人單位可以(yi)解(jie)除勞動(dong)(dong)合(he)(he)同(tong)(tong)(tong),法律(lv)規定得很清楚(chu),用(yong)人單位可解(jie)除勞動(dong)(dong)合(he)(he)同(tong)(tong)(tong)的(de)條(tiao)件是(shi)其必須舉證(zheng)(zheng)證(zheng)(zheng)明勞動(dong)(dong)者(zhe)在試(shi)用(yong)期間(jian)(jian)不(bu)符合(he)(he)錄用(yong)條(tiao)件,這實際上是(shi)限制了用(yong)人單位隨意解(jie)除勞動(dong)(dong)合(he)(he)同(tong)(tong)(tong),增加了用(yong)人單位的(de)舉證(zheng)(zheng)責任,如果(guo)用(yong)人單位沒有(you)證(zheng)(zheng)據(ju)證(zheng)(zheng)明勞動(dong)(dong)者(zhe)在試(shi)用(yong)期間(jian)(jian)不(bu)符合(he)(he)錄用(yong)條(tiao)件,用(yong)人單位就不(bu)能(neng)解(jie)除勞動(dong)(dong)合(he)(he)同(tong)(tong)(tong),否(fou)則,需(xu)承擔因違法解(jie)除勞動(dong)(dong)合(he)(he)同(tong)(tong)(tong)所帶來的(de)一切法律(lv)后(hou)果(guo)。
