沒有(you)簽訂(ding)勞(lao)動合(he)同(tong)(tong)(tong),口頭約定的試(shi)用(yong)(yong)期(qi)(qi)是無效的。《勞(lao)動合(he)同(tong)(tong)(tong)法》第十九條第四款規定:“試(shi)用(yong)(yong)期(qi)(qi)包含(han)在(zai)勞(lao)動合(he)同(tong)(tong)(tong)期(qi)(qi)限內。”同(tong)(tong)(tong)時第十條又規定:“建(jian)立(li)勞(lao)動關系,應當訂(ding)立(li)書(shu)面(mian)勞(lao)動合(he)同(tong)(tong)(tong)。”這(zhe)(zhe)些條款說(shuo)明有(you)了(le)書(shu)面(mian)的勞(lao)動合(he)同(tong)(tong)(tong),才能有(you)試(shi)用(yong)(yong)期(qi)(qi)。因此,你這(zhe)(zhe)半年的工作,實際(ji)上(shang)已經處(chu)于建(jian)立(li)了(le)勞(lao)動關系,而沒有(you)簽訂(ding)書(shu)面(mian)勞(lao)動合(he)同(tong)(tong)(tong)的狀態。這(zhe)(zhe)一(yi)點(dian)不會因為單位跟你口頭說(shuo)是見習(xi)或試(shi)用(yong)(yong)而有(you)所改變。
