答 根(gen)據法(fa)(fa)(fa)(fa)律(lv)規(gui)(gui)定(ding),勞動(dong)(dong)者有下列情形之一的(de),用(yong)(yong)人單(dan)位(wei)可(ke)(ke)以(yi)隨時解(jie)除勞動(dong)(dong)合同:1、在試用(yong)(yong)期(qi)間被證(zheng)明不符合錄用(yong)(yong)條件(jian)的(de);2、嚴重(zhong)(zhong)違反勞動(dong)(dong)紀律(lv)或(huo)(huo)者用(yong)(yong)人單(dan)位(wei)規(gui)(gui)章制(zhi)度的(de);3、嚴重(zhong)(zhong)失職,營私舞弊,對用(yong)(yong)人單(dan)位(wei)利益造(zao)成(cheng)重(zhong)(zhong)大損害(hai)的(de)(“重(zhong)(zhong)大損害(hai)”一般由企業(ye)內部(bu)規(gui)(gui)章進(jin)行規(gui)(gui)定(ding));4、被依法(fa)(fa)(fa)(fa)追(zhui)究刑(xing)事責任的(de)(根(gen)據規(gui)(gui)定(ding),勞動(dong)(dong)者被人民法(fa)(fa)(fa)(fa)院或(huo)(huo)有關部(bu)門判處拘役、3年以(yi)下有期(qi)徒(tu)刑(xing)緩刑(xing)及勞動(dong)(dong)教養的(de),均可(ke)(ke)以(yi)解(jie)除勞動(dong)(dong)合同);5、法(fa)(fa)(fa)(fa)律(lv)、法(fa)(fa)(fa)(fa)規(gui)(gui)規(gui)(gui)定(ding)的(de)其他(ta)情形。
