答(da) 由于試(shi)用(yong)(yong)(yong)(yong)期(qi)是勞(lao)動合同(tong)上所約定(ding)(ding)(ding)的(de)(de)一(yi)段期(qi)間,它的(de)(de)延(yan)長(chang)規則,適(shi)用(yong)(yong)(yong)(yong)勞(lao)動合同(tong)的(de)(de)一(yi)般規則。根(gen)據《勞(lao)動合同(tong)法》第三十五(wu)條規定(ding)(ding)(ding):“用(yong)(yong)(yong)(yong)人(ren)單位與勞(lao)動者協商(shang)一(yi)致,可以(yi)變(bian)更勞(lao)動合同(tong)約定(ding)(ding)(ding)的(de)(de)內容。”因此,用(yong)(yong)(yong)(yong)人(ren)單位如果希望變(bian)更試(shi)用(yong)(yong)(yong)(yong)期(qi)的(de)(de)長(chang)短,必須得到(dao)員工(gong)的(de)(de)書(shu)面同(tong)意。同(tong)時,由于試(shi)用(yong)(yong)(yong)(yong)期(qi)有最長(chang)限(xian)制,變(bian)更后的(de)(de)全部試(shi)用(yong)(yong)(yong)(yong)期(qi)不能超過法律的(de)(de)規定(ding)(ding)(ding)。
