我們公(gong)司第(di)一次跟(gen)我簽合(he)同(tong),簽了三個月,請(qing)問,規定勞動合(he)同(tong)的最低(di)年限是多長了么?

《勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)法(fa)》沒有規定(ding)(ding)(ding)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)的最低年限,但是該法(fa)的第(di)十四條規定(ding)(ding)(ding):“用人單位與(yu)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)者(zhe)(zhe)協商一(yi)(yi)致,可以訂(ding)立(li)(li)無固(gu)定(ding)(ding)(ding)期限勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)。有下列情形(xing)之一(yi)(yi),勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)者(zhe)(zhe)提出或者(zhe)(zhe)同(tong)(tong)意續訂(ding)、訂(ding)立(li)(li)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)的,除勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)者(zhe)(zhe)提出訂(ding)立(li)(li)固(gu)定(ding)(ding)(ding)期限勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)外(wai),應當訂(ding)立(li)(li)無固(gu)定(ding)(ding)(ding)期限勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)合(he)同(tong)(tong):……(三(san))連續訂(ding)立(li)(li)二次(ci)(ci)固(gu)定(ding)(ding)(ding)期限勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)合(he)同(tong)(tong),且勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)者(zhe)(zhe)沒有本法(fa)第(di)三(san)十九條和第(di)四十條第(di)一(yi)(yi)項、第(di)二項規定(ding)(ding)(ding)的情形(xing),續訂(ding)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)的。”這(zhe)樣一(yi)(yi)來(lai),從2008年起計算,員工與(yu)同(tong)(tong)一(yi)(yi)用人單位簽過兩次(ci)(ci)固(gu)定(ding)(ding)(ding)期限合(he)同(tong)(tong)后,第(di)三(san)次(ci)(ci)就有權要(yao)求(qiu)簽訂(ding)無固(gu)定(ding)(ding)(ding)期限勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)。前兩次(ci)(ci)固(gu)定(ding)(ding)(ding)期限越短,第(di)三(san)次(ci)(ci)來(lai)得(de)就越早。
