試用期期間被公司重新調了崗位,還需要重新計算試用期嗎?

根據《勞(lao)動(dong)合(he)(he)同法》第十九條規定(ding):“同一(yi)(yi)(yi)用(yong)(yong)(yong)人單位(wei)與同一(yi)(yi)(yi)勞(lao)動(dong)者只(zhi)能(neng)約定(ding)一(yi)(yi)(yi)次試用(yong)(yong)(yong)期(qi)(qi)(qi)(qi)。” 試用(yong)(yong)(yong)期(qi)(qi)(qi)(qi)是與公司(si)在勞(lao)動(dong)合(he)(he)同上協商確定(ding)的(de),如果試用(yong)(yong)(yong)期(qi)(qi)(qi)(qi)已經過了(le)(le),調換(huan)工作崗(gang)位(wei),不能(neng)重新(xin)設(she)立(li)試用(yong)(yong)(yong)期(qi)(qi)(qi)(qi)。如果在試用(yong)(yong)(yong)期(qi)(qi)(qi)(qi)內調整(zheng)了(le)(le)工作崗(gang)位(wei),之前已經消耗的(de)試用(yong)(yong)(yong)期(qi)(qi)(qi)(qi)不用(yong)(yong)(yong)重新(xin)再來(lai)一(yi)(yi)(yi)遍(bian),只(zhi)要繼續履行剩余試用(yong)(yong)(yong)期(qi)(qi)(qi)(qi)即可。如果因為調換(huan)了(le)(le)部門(men),雙方協商一(yi)(yi)(yi)致(zhi),依法變更試用(yong)(yong)(yong)期(qi)(qi)(qi)(qi)長短的(de)話(hua),之前已經履行的(de)部分試用(yong)(yong)(yong)期(qi)(qi)(qi)(qi)也不用(yong)(yong)(yong)重新(xin)計算,而是按新(xin)的(de)試用(yong)(yong)(yong)期(qi)(qi)(qi)(qi)長短履行剩余的(de)試用(yong)(yong)(yong)期(qi)(qi)(qi)(qi)。
