剛進公司只簽試用期合同合法嗎?

我(wo)昨天剛進(jin)公司(si),公司(si)的(de)人力只和我(wo)簽(qian)訂試(shi)用期合(he)(he)同,請問剛進(jin)公司(si)只簽(qian)試(shi)用期合(he)(he)同合(he)(he)法嗎?

勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)和(he)用(yong)(yong)(yong)(yong)人(ren)(ren)單位(wei)雙(shuang)方(fang)同意建(jian)立(li)勞(lao)(lao)(lao)動(dong)(dong)(dong)關(guan)系,用(yong)(yong)(yong)(yong)人(ren)(ren)單位(wei)應(ying)當在勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)開始工作(zuo)之(zhi)時(shi)就與(yu)其(qi)簽(qian)(qian)訂(ding)勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)(he)同。對于(yu)新上(shang)崗的勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe),用(yong)(yong)(yong)(yong)人(ren)(ren)單位(wei)與(yu)勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)可以約(yue)定(ding)試(shi)用(yong)(yong)(yong)(yong)期(qi)也可以不約(yue)定(ding)試(shi)用(yong)(yong)(yong)(yong)期(qi)。如果用(yong)(yong)(yong)(yong)人(ren)(ren)單位(wei)與(yu)勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)約(yue)定(ding)試(shi)用(yong)(yong)(yong)(yong)期(qi),試(shi)用(yong)(yong)(yong)(yong)期(qi)應(ying)在勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)(he)同中約(yue)定(ding)。勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)(he)同是勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)與(yu)用(yong)(yong)(yong)(yong)人(ren)(ren)單位(wei)確立(li)勞(lao)(lao)(lao)動(dong)(dong)(dong)關(guan)系,明確雙(shuang)方(fang)的權(quan)利(li)和(he)義務(wu)的協(xie)議,具有法(fa)律約(yue)束力。簽(qian)(qian)訂(ding)勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)(he)同對用(yong)(yong)(yong)(yong)人(ren)(ren)單位(wei)和(he)勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)都(dou)很重(zhong)要,如果發生(sheng),在申(shen)請勞(lao)(lao)(lao)動(dong)(dong)(dong)爭議仲裁時(shi),有利(li)于(yu)維(wei)護勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)和(he)用(yong)(yong)(yong)(yong)人(ren)(ren)單位(wei)雙(shuang)方(fang)的合(he)(he)法(fa)權(quan)益。
