答(da) 《勞(lao)動(dong)(dong)合(he)(he)(he)同(tong)(tong)(tong)(tong)法(fa)》第(di)十(shi)一(yi)條(tiao)用(yong)(yong)(yong)人單位(wei)未(wei)在用(yong)(yong)(yong)工的(de)同(tong)(tong)(tong)(tong)時訂立(li)書面勞(lao)動(dong)(dong)合(he)(he)(he)同(tong)(tong)(tong)(tong),與(yu)(yu)勞(lao)動(dong)(dong)者約定的(de)勞(lao)動(dong)(dong)報酬不(bu)(bu)明(ming)確(que)的(de),新招用(yong)(yong)(yong)的(de)勞(lao)動(dong)(dong)者的(de)勞(lao)動(dong)(dong)報酬按照集(ji)體合(he)(he)(he)同(tong)(tong)(tong)(tong)規(gui)定的(de)標(biao)準執行(xing);沒有集(ji)體合(he)(he)(he)同(tong)(tong)(tong)(tong)或者集(ji)體合(he)(he)(he)同(tong)(tong)(tong)(tong)未(wei)規(gui)定的(de),實行(xing)同(tong)(tong)(tong)(tong)工同(tong)(tong)(tong)(tong)酬。用(yong)(yong)(yong)人單位(wei)自用(yong)(yong)(yong)工之日起(qi)滿一(yi)年不(bu)(bu)與(yu)(yu)勞(lao)動(dong)(dong)者訂立(li)書面勞(lao)動(dong)(dong)合(he)(he)(he)同(tong)(tong)(tong)(tong)的(de),視為用(yong)(yong)(yong)人單位(wei)與(yu)(yu)勞(lao)動(dong)(dong)者已(yi)訂立(li)無固定期(qi)限勞(lao)動(dong)(dong)合(he)(he)(he)同(tong)(tong)(tong)(tong)。
