答(da) 《勞(lao)(lao)動合(he)同(tong)(tong)(tong)法》第(di)十一條用(yong)人(ren)單位(wei)未在用(yong)工的同(tong)(tong)(tong)時訂立(li)書面(mian)勞(lao)(lao)動合(he)同(tong)(tong)(tong),與勞(lao)(lao)動者約定(ding)的勞(lao)(lao)動報酬(chou)不明確(que)的,新招用(yong)的勞(lao)(lao)動者的勞(lao)(lao)動報酬(chou)按照集(ji)體合(he)同(tong)(tong)(tong)規(gui)定(ding)的標準執行;沒(mei)有集(ji)體合(he)同(tong)(tong)(tong)或者集(ji)體合(he)同(tong)(tong)(tong)未規(gui)定(ding)的,實行同(tong)(tong)(tong)工同(tong)(tong)(tong)酬(chou)。用(yong)人(ren)單位(wei)自用(yong)工之日起滿一年不與勞(lao)(lao)動者訂立(li)書面(mian)勞(lao)(lao)動合(he)同(tong)(tong)(tong)的,視為(wei)用(yong)人(ren)單位(wei)與勞(lao)(lao)動者已訂立(li)無(wu)固定(ding)期限勞(lao)(lao)動合(he)同(tong)(tong)(tong)。
