用人單位在試用期內能否隨意辭退員工?

我是個職場新人,現在想咨詢(xun)一下,請問用(yong)人單位在試(shi)用(yong)期內能否隨意辭退(tui)員(yuan)工?

根據(ju)《勞(lao)(lao)(lao)動(dong)(dong)(dong)法》第二十(shi)五條(tiao)規定(ding),勞(lao)(lao)(lao)動(dong)(dong)(dong)者在試用(yong)(yong)(yong)(yong)期間(jian)被證明不符合(he)錄用(yong)(yong)(yong)(yong)條(tiao)件的,用(yong)(yong)(yong)(yong)人單位(wei)可以解除(chu)(chu)(chu)勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同,法律規定(ding)得很清(qing)楚,用(yong)(yong)(yong)(yong)人單位(wei)可解除(chu)(chu)(chu)勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同的條(tiao)件是(shi)其必須舉(ju)(ju)證證明勞(lao)(lao)(lao)動(dong)(dong)(dong)者在試用(yong)(yong)(yong)(yong)期間(jian)不符合(he)錄用(yong)(yong)(yong)(yong)條(tiao)件,這(zhe)實際上是(shi)限制了用(yong)(yong)(yong)(yong)人單位(wei)隨意解除(chu)(chu)(chu)勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同,增加了用(yong)(yong)(yong)(yong)人單位(wei)的舉(ju)(ju)證責任(ren),如果(guo)用(yong)(yong)(yong)(yong)人單位(wei)沒有證據(ju)證明勞(lao)(lao)(lao)動(dong)(dong)(dong)者在試用(yong)(yong)(yong)(yong)期間(jian)不符合(he)錄用(yong)(yong)(yong)(yong)條(tiao)件,用(yong)(yong)(yong)(yong)人單位(wei)就不能解除(chu)(chu)(chu)勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同,否則(ze),需承擔因(yin)違法解除(chu)(chu)(chu)勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同所帶來的一(yi)切法律后果(guo)。
