答(da) 《中(zhong)華人(ren)民共(gong)和國勞(lao)(lao)動(dong)(dong)(dong)合(he)(he)(he)(he)同法》第(di)八十(shi)二條(tiao)規定(ding):“用(yong)(yong)(yong)人(ren)單(dan)位自用(yong)(yong)(yong)工(gong)(gong)(gong)之(zhi)日起(qi)超過一個月不滿一年(nian)未與(yu)勞(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)訂(ding)立書面(mian)勞(lao)(lao)動(dong)(dong)(dong)合(he)(he)(he)(he)同的(de)(de)(de),應當向(xiang)勞(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)每月支付二倍的(de)(de)(de)工(gong)(gong)(gong)資……” 第(di)十(shi)四條(tiao)還規定(ding):“……用(yong)(yong)(yong)人(ren)單(dan)位自用(yong)(yong)(yong)工(gong)(gong)(gong)之(zhi)日起(qi)滿一年(nian)不與(yu)勞(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)訂(ding)立書面(mian)勞(lao)(lao)動(dong)(dong)(dong)合(he)(he)(he)(he)同的(de)(de)(de),視為用(yong)(yong)(yong)人(ren)單(dan)位與(yu)勞(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)已訂(ding)立無固定(ding)期限勞(lao)(lao)動(dong)(dong)(dong)合(he)(he)(he)(he)同。” 所以,員工(gong)(gong)(gong)入職第(di)一天(tian)就要簽合(he)(he)(he)(he)同的(de)(de)(de)。
