如果勞(lao)動(dong)(dong)合同(tong)被確認無效,且勞(lao)動(dong)(dong)者(zhe)已付出勞(lao)動(dong)(dong)的,則用人單位應當(dang)向勞(lao)動(dong)(dong)者(zhe)支付勞(lao)動(dong)(dong)報酬。勞(lao)動(dong)(dong)報酬的數(shu)額,參照本單位相同(tong)或(huo)者(zhe)相近崗位勞(lao)動(dong)(dong)者(zhe)的勞(lao)動(dong)(dong)報酬確定。并且如果是因單位原因造成(cheng)合同(tong)無效的,員工可以立即解除合同(tong),并且要求單位支付補償金。
