最近剛剛在濟南找(zhao)到一份喜歡的工作,昨天簽(qian)的合(he)同,哪(na)些(xie)情形(xing)下用人企業(ye)可以單方面解除勞動合(he)同?

第(di)一(yi)種情(qing)(qing)況:以下情(qing)(qing)形下,用(yong)人(ren)單(dan)(dan)位(wei)(wei)(wei)可(ke)以隨時解除(chu)勞(lao)(lao)動(dong)(dong)(dong)合同,而(er)不(bu)必履行(xing)任何手續和義務(wu): (1) 在(zai)試(shi)用(yong)期內,勞(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)被(bei)證明不(bu)符(fu)合錄用(yong)條(tiao)件(jian); (2) 勞(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)嚴(yan)重(zhong)違反(fan)勞(lao)(lao)動(dong)(dong)(dong)紀律或(huo)用(yong)人(ren)單(dan)(dan)位(wei)(wei)(wei)規章制度的(de)(de)(de); (3) 嚴(yan)重(zhong)失(shi)職,營失(shi)舞弊,對用(yong)人(ren)單(dan)(dan)位(wei)(wei)(wei)利益(yi)造成重(zhong)大(da)損害(hai)的(de)(de)(de); (4) 被(bei)依法追究刑事責任的(de)(de)(de)。 第(di)二種情(qing)(qing)況:用(yong)人(ren)單(dan)(dan)位(wei)(wei)(wei)有權(quan)解除(chu)勞(lao)(lao)動(dong)(dong)(dong)合同,但應(ying)當提前(qian)30日(ri)以書面形式(shi)通知勞(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)本(ben)人(ren): (1)勞(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)患病(bing)或(huo)者(zhe)(zhe)非(fei)因工(gong)(gong)(gong)負傷,醫療(liao)期滿后,不(bu)能從事原工(gong)(gong)(gong)作(zuo)(zuo)也不(bu)能從事由(you)用(yong)人(ren)單(dan)(dan)位(wei)(wei)(wei)另行(xing)安排的(de)(de)(de)工(gong)(gong)(gong)作(zuo)(zuo)的(de)(de)(de); (2)勞(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)不(bu)能勝(sheng)任工(gong)(gong)(gong)作(zuo)(zuo),經(jing)過培訓或(huo)者(zhe)(zhe)調整工(gong)(gong)(gong)作(zuo)(zuo)崗位(wei)(wei)(wei),仍不(bu)能勝(sheng)任工(gong)(gong)(gong)作(zuo)(zuo)的(de)(de)(de); (3)勞(lao)(lao)動(dong)(dong)(dong)合同訂(ding)立時所依據的(de)(de)(de)客觀情(qing)(qing)況發生重(zhong)大(da)變化,致(zhi)使原勞(lao)(lao)動(dong)(dong)(dong)合同無(wu)法履行(xing),經(jing)當事人(ren)協(xie)商(shang)不(bu)能就變更勞(lao)(lao)動(dong)(dong)(dong)合同達成協(xie)議的(de)(de)(de)。 第(di)三種情(qing)(qing)況,用(yong)人(ren)單(dan)(dan)位(wei)(wei)(wei)瀕(bin)臨破產(chan)(chan)進(jin)行(xing)法定整頓期間(jian)或(huo)者(zhe)(zhe)生產(chan)(chan)經(jing)營狀況發生嚴(yan)重(zhong)困難,確需裁減人(ren)員的(de)(de)(de),應(ying)當提前(qian)三天通知。
