答(da) 第一種情(qing)(qing)況(kuang)(kuang):以下(xia)情(qing)(qing)形(xing)下(xia),用(yong)人(ren)(ren)單(dan)(dan)位(wei)(wei)(wei)(wei)可以隨時解(jie)除勞動(dong)(dong)合(he)(he)同(tong),而不(bu)(bu)必履行(xing)任(ren)(ren)何手(shou)續和(he)義務: (1) 在試用(yong)期(qi)內,勞動(dong)(dong)者(zhe)(zhe)被證明不(bu)(bu)符合(he)(he)錄(lu)用(yong)條件; (2) 勞動(dong)(dong)者(zhe)(zhe)嚴重(zhong)違反(fan)勞動(dong)(dong)紀律或用(yong)人(ren)(ren)單(dan)(dan)位(wei)(wei)(wei)(wei)規章制度(du)的; (3) 嚴重(zhong)失職,營失舞(wu)弊,對用(yong)人(ren)(ren)單(dan)(dan)位(wei)(wei)(wei)(wei)利益(yi)造(zao)成重(zhong)大損害(hai)的; (4) 被依(yi)法追究刑事(shi)責任(ren)(ren)的。 第二(er)種情(qing)(qing)況(kuang)(kuang):用(yong)人(ren)(ren)單(dan)(dan)位(wei)(wei)(wei)(wei)有權解(jie)除勞動(dong)(dong)合(he)(he)同(tong),但(dan)應當提前(qian)30日以書面形(xing)式通知勞動(dong)(dong)者(zhe)(zhe)本人(ren)(ren): (1)勞動(dong)(dong)者(zhe)(zhe)患(huan)病或者(zhe)(zhe)非因工(gong)(gong)負傷,醫療期(qi)滿(man)后,不(bu)(bu)能從事(shi)原工(gong)(gong)作也不(bu)(bu)能從事(shi)由用(yong)人(ren)(ren)單(dan)(dan)位(wei)(wei)(wei)(wei)另(ling)行(xing)安排(pai)的工(gong)(gong)作的; (2)勞動(dong)(dong)者(zhe)(zhe)不(bu)(bu)能勝任(ren)(ren)工(gong)(gong)作,經(jing)(jing)過培訓或者(zhe)(zhe)調(diao)整工(gong)(gong)作崗位(wei)(wei)(wei)(wei),仍不(bu)(bu)能勝任(ren)(ren)工(gong)(gong)作的; (3)勞動(dong)(dong)合(he)(he)同(tong)訂立時所(suo)依(yi)據的客觀情(qing)(qing)況(kuang)(kuang)發生(sheng)重(zhong)大變化,致使(shi)原勞動(dong)(dong)合(he)(he)同(tong)無法履行(xing),經(jing)(jing)當事(shi)人(ren)(ren)協商不(bu)(bu)能就變更勞動(dong)(dong)合(he)(he)同(tong)達成協議的。 第三種情(qing)(qing)況(kuang)(kuang),用(yong)人(ren)(ren)單(dan)(dan)位(wei)(wei)(wei)(wei)瀕臨破產進行(xing)法定(ding)整頓期(qi)間或者(zhe)(zhe)生(sheng)產經(jing)(jing)營狀況(kuang)(kuang)發生(sheng)嚴重(zhong)困難,確需裁減人(ren)(ren)員的,應當提前(qian)三天通知。
