我現在在公(gong)司屬于試用期(qi)員工,想咨(zi)詢一下,試用期(qi)遭遇經濟性(xing)裁員怎么(me)辦啊?

答(da) 如果(guo)勞(lao)(lao)(lao)動合同(tong)未到期(qi),根(gen)據(ju)(ju)《中華人(ren)(ren)民共和國和勞(lao)(lao)(lao)動合同(tong)法》第四(si)十一(yi)條規定,因勞(lao)(lao)(lao)動合同(tong)訂立時(shi)所依據(ju)(ju)的客觀經濟情(qing)(qing)況發生重(zhong)大變化,致使勞(lao)(lao)(lao)動合同(tong)無法履行,需要裁(cai)減(jian)(jian)人(ren)(ren)員(yuan)二十人(ren)(ren)以(yi)上(shang)或者(zhe)裁(cai)減(jian)(jian)不(bu)足二十人(ren)(ren)但占(zhan)企業職工(gong)(gong)總數百分(fen)之十以(yi)上(shang)的,用人(ren)(ren)單位(wei)可以(yi)經濟性裁(cai)員(yuan)。但是裁(cai)員(yuan)必須(xu)由(you)用人(ren)(ren)單位(wei)提(ti)前(qian)三十日向工(gong)(gong)會(hui)或者(zhe)全體(ti)職工(gong)(gong)說明(ming)情(qing)(qing)況,聽取工(gong)(gong)會(hui)或者(zhe)職工(gong)(gong)的意見,并且裁(cai)減(jian)(jian)人(ren)(ren)員(yuan)方案經向勞(lao)(lao)(lao)動行政部門報告。
