試用期過長應該怎么辦呢?

答 根(gen)(gen)據(ju)《勞(lao)(lao)動合(he)同法(fa)(fa)》第(di)八(ba)十三條(tiao)規定(ding)(ding):“用(yong)(yong)(yong)(yong)人(ren)單(dan)位違反本法(fa)(fa)規定(ding)(ding)與勞(lao)(lao)動者約(yue)定(ding)(ding)試用(yong)(yong)(yong)(yong)期(qi)(qi)(qi)(qi)的(de)(de),由勞(lao)(lao)動行(xing)(xing)(xing)政部(bu)門責(ze)令改(gai)正;違法(fa)(fa)約(yue)定(ding)(ding)的(de)(de)試用(yong)(yong)(yong)(yong)期(qi)(qi)(qi)(qi)已經(jing)履(lv)行(xing)(xing)(xing)的(de)(de),由用(yong)(yong)(yong)(yong)人(ren)單(dan)位以勞(lao)(lao)動者試用(yong)(yong)(yong)(yong)期(qi)(qi)(qi)(qi)滿月(yue)工(gong)資為標準,按已經(jing)履(lv)行(xing)(xing)(xing)的(de)(de)超過法(fa)(fa)定(ding)(ding)試用(yong)(yong)(yong)(yong)期(qi)(qi)(qi)(qi)的(de)(de)期(qi)(qi)(qi)(qi)間(jian)向勞(lao)(lao)動者支付賠償(chang)金。”根(gen)(gen)據(ju)這條(tiao)規定(ding)(ding),用(yong)(yong)(yong)(yong)人(ren)單(dan)位違反規定(ding)(ding)與勞(lao)(lao)動者約(yue)定(ding)(ding)試用(yong)(yong)(yong)(yong)期(qi)(qi)(qi)(qi)的(de)(de),如(ru)果(guo)試用(yong)(yong)(yong)(yong)期(qi)(qi)(qi)(qi)還未實際履(lv)行(xing)(xing)(xing)的(de)(de),則可以由勞(lao)(lao)動行(xing)(xing)(xing)政部(bu)門責(ze)令用(yong)(yong)(yong)(yong)人(ren)單(dan)位改(gai)正,避免(mian)違法(fa)(fa)約(yue)定(ding)(ding)的(de)(de)試用(yong)(yong)(yong)(yong)期(qi)(qi)(qi)(qi)付諸實踐,有效保護勞(lao)(lao)動者的(de)(de)合(he)法(fa)(fa)權(quan)益。
