不得終止勞動合同的情形有哪些呢?

勞(lao)動(dong)合同(tong)期滿或者(zhe)當事人約定的勞(lao)動(dong)合同(tong)終(zhong)止(zhi)條件出現,勞(lao)動(dong)合同(tong)即行終(zhong)止(zhi)。那么(me)不(bu)得終(zhong)止(zhi)勞(lao)動(dong)合同(tong)的情形有哪些呢?

首先勞(lao)(lao)(lao)動(dong)(dong)(dong)和社會保障部等(deng)部門《關于進一步推(tui)行平(ping)等(deng)協(xie)商和集體合同(tong)(tong)制度的(de)(de)通知》規定,參與集體協(xie)商簽訂集體合同(tong)(tong)的(de)(de)職(zhi)(zhi)工協(xie)商代(dai)表(biao)在任期(qi)內(nei),勞(lao)(lao)(lao)動(dong)(dong)(dong)合同(tong)(tong)期(qi)滿的(de)(de),企業(ye)原(yuan)則上應當與其續簽勞(lao)(lao)(lao)動(dong)(dong)(dong)合同(tong)(tong)至(zhi)任期(qi)屆(jie)(jie)滿。勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)(zhe)在醫(yi)(yi)(yi)療(liao)期(qi)、孕期(qi)、產(chan)期(qi)和哺(bu)乳期(qi)內(nei),勞(lao)(lao)(lao)動(dong)(dong)(dong)合同(tong)(tong)期(qi)限(xian)屆(jie)(jie)滿時,用人單(dan)位不得終止(zhi)勞(lao)(lao)(lao)動(dong)(dong)(dong)合同(tong)(tong)。勞(lao)(lao)(lao)動(dong)(dong)(dong)合同(tong)(tong)的(de)(de)期(qi)限(xian)應自動(dong)(dong)(dong)延續至(zhi)醫(yi)(yi)(yi)療(liao)期(qi)、孕期(qi)、產(chan)期(qi)和哺(bu)乳期(qi)期(qi)滿為止(zhi)。其次用人單(dan)位不得終止(zhi)傷(shang)殘(can)程度為1~6級的(de)(de)工傷(shang)職(zhi)(zhi)工的(de)(de)勞(lao)(lao)(lao)動(dong)(dong)(dong)合同(tong)(tong),用人單(dan)位對未進行離崗前職(zhi)(zhi)業(ye)健(jian)康檢查的(de)(de)勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)(zhe)不得解(jie)除或者(zhe)(zhe)(zhe)終止(zhi)與其訂立的(de)(de)勞(lao)(lao)(lao)動(dong)(dong)(dong)合同(tong)(tong);用人單(dan)位在疑似(si)職(zhi)(zhi)業(ye)病病人診斷(duan)或者(zhe)(zhe)(zhe)醫(yi)(yi)(yi)學(xue)觀(guan)察期(qi)間,不得解(jie)除或者(zhe)(zhe)(zhe)終止(zhi)與其訂立的(de)(de)勞(lao)(lao)(lao)動(dong)(dong)(dong)合同(tong)(tong)。
