答(da) 首先勞(lao)動(dong)和(he)社會保障部等部門《關于(yu)進(jin)一步推(tui)行(xing)平等協(xie)(xie)商和(he)集體(ti)合(he)同(tong)(tong)制度的(de)通(tong)知(zhi)》規定,參與(yu)集體(ti)協(xie)(xie)商簽(qian)(qian)訂(ding)集體(ti)合(he)同(tong)(tong)的(de)職工協(xie)(xie)商代表在任(ren)期(qi)(qi)(qi)(qi)內(nei),勞(lao)動(dong)合(he)同(tong)(tong)期(qi)(qi)(qi)(qi)滿(man)的(de),企業原則(ze)上應當與(yu)其(qi)續(xu)簽(qian)(qian)勞(lao)動(dong)合(he)同(tong)(tong)至(zhi)任(ren)期(qi)(qi)(qi)(qi)屆(jie)滿(man)。勞(lao)動(dong)者(zhe)在醫(yi)療(liao)期(qi)(qi)(qi)(qi)、孕期(qi)(qi)(qi)(qi)、產期(qi)(qi)(qi)(qi)和(he)哺乳期(qi)(qi)(qi)(qi)內(nei),勞(lao)動(dong)合(he)同(tong)(tong)期(qi)(qi)(qi)(qi)限屆(jie)滿(man)時,用(yong)人(ren)(ren)單(dan)位不得終(zhong)止勞(lao)動(dong)合(he)同(tong)(tong)。勞(lao)動(dong)合(he)同(tong)(tong)的(de)期(qi)(qi)(qi)(qi)限應自動(dong)延(yan)續(xu)至(zhi)醫(yi)療(liao)期(qi)(qi)(qi)(qi)、孕期(qi)(qi)(qi)(qi)、產期(qi)(qi)(qi)(qi)和(he)哺乳期(qi)(qi)(qi)(qi)期(qi)(qi)(qi)(qi)滿(man)為止。其(qi)次用(yong)人(ren)(ren)單(dan)位不得終(zhong)止傷殘(can)程度為1~6級的(de)工傷職工的(de)勞(lao)動(dong)合(he)同(tong)(tong),用(yong)人(ren)(ren)單(dan)位對未進(jin)行(xing)離(li)崗(gang)前(qian)職業健康檢查(cha)的(de)勞(lao)動(dong)者(zhe)不得解除(chu)或者(zhe)終(zhong)止與(yu)其(qi)訂(ding)立的(de)勞(lao)動(dong)合(he)同(tong)(tong);用(yong)人(ren)(ren)單(dan)位在疑似職業病病人(ren)(ren)診斷或者(zhe)醫(yi)學(xue)觀察期(qi)(qi)(qi)(qi)間,不得解除(chu)或者(zhe)終(zhong)止與(yu)其(qi)訂(ding)立的(de)勞(lao)動(dong)合(he)同(tong)(tong)。
