試用期含在勞動合同期限內?

問(wen) 我(wo)現在(zai)(zai)是試(shi)用(yong)期(qi)員工,想(xiang)咨詢一下,試(shi)用(yong)期(qi)含(han)在(zai)(zai)勞動(dong)合同期(qi)限(xian)內(nei)么?

根據(ju)《勞(lao)動(dong)(dong)(dong)(dong)合(he)同(tong)法(fa)》第(di)19條的(de)規(gui)(gui)定:“試(shi)(shi)用(yong)期(qi)(qi)(qi)包含(han)在勞(lao)動(dong)(dong)(dong)(dong)合(he)同(tong)期(qi)(qi)(qi)限(xian)內(nei)。”其實(shi),用(yong)人(ren)單位(wei)(wei)在事(shi)實(shi)上(shang)雇用(yong)員工(gong)時就產生勞(lao)動(dong)(dong)(dong)(dong)關系,就應(ying)當(dang)與(yu)試(shi)(shi)用(yong)期(qi)(qi)(qi)內(nei)的(de)勞(lao)動(dong)(dong)(dong)(dong)者(zhe)訂(ding)立書(shu)面勞(lao)動(dong)(dong)(dong)(dong)合(he)同(tong),并按照勞(lao)動(dong)(dong)(dong)(dong)合(he)同(tong)法(fa)的(de)規(gui)(gui)定約(yue)定試(shi)(shi)用(yong)期(qi)(qi)(qi)的(de)期(qi)(qi)(qi)限(xian)。  如果(guo)用(yong)人(ren)單位(wei)(wei)違(wei)法(fa)約(yue)定試(shi)(shi)用(yong)期(qi)(qi)(qi)期(qi)(qi)(qi)限(xian)規(gui)(gui)定的(de),那么應(ying)當(dang)按照勞(lao)動(dong)(dong)(dong)(dong)合(he)同(tong)法(fa)第(di)83條的(de)規(gui)(gui)定承擔法(fa)律責任:即用(yong)人(ren)單位(wei)(wei)違(wei)法(fa)約(yue)定試(shi)(shi)用(yong)期(qi)(qi)(qi)的(de),由勞(lao)動(dong)(dong)(dong)(dong)行政部(bu)門責令改正;違(wei)法(fa)約(yue)定的(de)試(shi)(shi)用(yong)期(qi)(qi)(qi)已(yi)經(jing)履行的(de),由用(yong)人(ren)單位(wei)(wei)以勞(lao)動(dong)(dong)(dong)(dong)者(zhe)試(shi)(shi)用(yong)期(qi)(qi)(qi)滿月工(gong)資為(wei)標準(zhun),按已(yi)經(jing)履行的(de)超過(guo)法(fa)定期(qi)(qi)(qi)限(xian)的(de)期(qi)(qi)(qi)間向勞(lao)動(dong)(dong)(dong)(dong)者(zhe)支(zhi)付賠償金。如果(guo)沒有訂(ding)立書(shu)面勞(lao)動(dong)(dong)(dong)(dong)合(he)同(tong),也要(yao)依(yi)據(ju)勞(lao)動(dong)(dong)(dong)(dong)合(he)同(tong)法(fa)和實(shi)施條例的(de)規(gui)(gui)定來辦理。
