試用期含在勞動合同期限內?

答 根據《勞(lao)(lao)(lao)動(dong)合同(tong)(tong)法(fa)(fa)》第19條的(de)(de)規定(ding)(ding)(ding):“試(shi)(shi)用(yong)(yong)(yong)(yong)(yong)期(qi)(qi)包含在(zai)勞(lao)(lao)(lao)動(dong)合同(tong)(tong)期(qi)(qi)限(xian)內。”其實(shi),用(yong)(yong)(yong)(yong)(yong)人單(dan)位(wei)在(zai)事實(shi)上雇用(yong)(yong)(yong)(yong)(yong)員(yuan)工時就(jiu)產生勞(lao)(lao)(lao)動(dong)關(guan)系(xi),就(jiu)應當與(yu)試(shi)(shi)用(yong)(yong)(yong)(yong)(yong)期(qi)(qi)內的(de)(de)勞(lao)(lao)(lao)動(dong)者訂立書面勞(lao)(lao)(lao)動(dong)合同(tong)(tong),并按(an)照勞(lao)(lao)(lao)動(dong)合同(tong)(tong)法(fa)(fa)的(de)(de)規定(ding)(ding)(ding)約(yue)定(ding)(ding)(ding)試(shi)(shi)用(yong)(yong)(yong)(yong)(yong)期(qi)(qi)的(de)(de)期(qi)(qi)限(xian)。 如果用(yong)(yong)(yong)(yong)(yong)人單(dan)位(wei)違法(fa)(fa)約(yue)定(ding)(ding)(ding)試(shi)(shi)用(yong)(yong)(yong)(yong)(yong)期(qi)(qi)期(qi)(qi)限(xian)規定(ding)(ding)(ding)的(de)(de),那么應當按(an)照勞(lao)(lao)(lao)動(dong)合同(tong)(tong)法(fa)(fa)第83條的(de)(de)規定(ding)(ding)(ding)承擔法(fa)(fa)律責任:即用(yong)(yong)(yong)(yong)(yong)人單(dan)位(wei)違法(fa)(fa)約(yue)定(ding)(ding)(ding)試(shi)(shi)用(yong)(yong)(yong)(yong)(yong)期(qi)(qi)的(de)(de),由勞(lao)(lao)(lao)動(dong)行政部門責令改正;違法(fa)(fa)約(yue)定(ding)(ding)(ding)的(de)(de)試(shi)(shi)用(yong)(yong)(yong)(yong)(yong)期(qi)(qi)已經(jing)履(lv)行的(de)(de),由用(yong)(yong)(yong)(yong)(yong)人單(dan)位(wei)以勞(lao)(lao)(lao)動(dong)者試(shi)(shi)用(yong)(yong)(yong)(yong)(yong)期(qi)(qi)滿月(yue)工資(zi)為標(biao)準(zhun),按(an)已經(jing)履(lv)行的(de)(de)超過法(fa)(fa)定(ding)(ding)(ding)期(qi)(qi)限(xian)的(de)(de)期(qi)(qi)間(jian)向勞(lao)(lao)(lao)動(dong)者支付賠償金(jin)。如果沒有訂立書面勞(lao)(lao)(lao)動(dong)合同(tong)(tong),也要依據勞(lao)(lao)(lao)動(dong)合同(tong)(tong)法(fa)(fa)和實(shi)施條例的(de)(de)規定(ding)(ding)(ding)來辦理(li)。
