在(zai)勞(lao)(lao)動(dong)(dong)合(he)同(tong)中可以(yi)(yi)(yi)約定(ding)(ding)試(shi)(shi)(shi)用(yong)期(qi),勞(lao)(lao)動(dong)(dong)合(he)同(tong)期(qi)限三(san)個月(yue)(yue)以(yi)(yi)(yi)上不(bu)滿一(yi)年(nian)的,試(shi)(shi)(shi)用(yong)期(qi)不(bu)得超過(guo)一(yi)個月(yue)(yue)勞(lao)(lao)動(dong)(dong)合(he)同(tong)期(qi)限一(yi)年(nian)以(yi)(yi)(yi)上不(bu)滿三(san)年(nian)的,試(shi)(shi)(shi)用(yong)期(qi)不(bu)得超過(guo)二(er)個月(yue)(yue)三(san)年(nian)以(yi)(yi)(yi)上固(gu)定(ding)(ding)期(qi)限和(he)無(wu)固(gu)定(ding)(ding)期(qi)限的勞(lao)(lao)動(dong)(dong)合(he)同(tong),試(shi)(shi)(shi)用(yong)期(qi)不(bu)得超過(guo)六個月(yue)(yue)。勞(lao)(lao)動(dong)(dong)合(he)同(tong)中約定(ding)(ding)試(shi)(shi)(shi)用(yong)期(qi)的,試(shi)(shi)(shi)用(yong)期(qi)應當包括在(zai)勞(lao)(lao)動(dong)(dong)合(he)同(tong)期(qi)限內。續(xu)訂勞(lao)(lao)動(dong)(dong)合(he)同(tong)的,不(bu)得再(zai)約定(ding)(ding)試(shi)(shi)(shi)用(yong)期(qi)。
