在勞動合同(tong)(tong)中可以(yi)約定(ding)試(shi)(shi)用期(qi)(qi),勞動合同(tong)(tong)期(qi)(qi)限三個月以(yi)上(shang)(shang)不滿(man)一年(nian)(nian)的,試(shi)(shi)用期(qi)(qi)不得(de)超過一個月勞動合同(tong)(tong)期(qi)(qi)限一年(nian)(nian)以(yi)上(shang)(shang)不滿(man)三年(nian)(nian)的,試(shi)(shi)用期(qi)(qi)不得(de)超過二個月三年(nian)(nian)以(yi)上(shang)(shang)固定(ding)期(qi)(qi)限和無(wu)固定(ding)期(qi)(qi)限的勞動合同(tong)(tong),試(shi)(shi)用期(qi)(qi)不得(de)超過六個月。勞動合同(tong)(tong)中約定(ding)試(shi)(shi)用期(qi)(qi)的,試(shi)(shi)用期(qi)(qi)應(ying)當包(bao)括在勞動合同(tong)(tong)期(qi)(qi)限內(nei)。續訂勞動合同(tong)(tong)的,不得(de)再(zai)約定(ding)試(shi)(shi)用期(qi)(qi)。
