根據《勞(lao)(lao)動(dong)(dong)(dong)(dong)合同(tong)法》第38條規定,單(dan)(dan)位未(wei)按照勞(lao)(lao)動(dong)(dong)(dong)(dong)合同(tong)約(yue)定提(ti)供勞(lao)(lao)動(dong)(dong)(dong)(dong)保護或者(zhe)勞(lao)(lao)動(dong)(dong)(dong)(dong)條件(jian)的(de)(de),勞(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)可(ke)以(yi)(yi)解除勞(lao)(lao)動(dong)(dong)(dong)(dong)合同(tong)。如果單(dan)(dan)位安排勞(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)工(gong)作(zuo)的(de)(de)環境和(he)工(gong)作(zuo)條件(jian)惡(e)劣,存在安全(quan)隱(yin)患或漏洞,有可(ke)能給勞(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)的(de)(de)安全(quan)帶來威脅;或者(zhe)勞(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)的(de)(de)工(gong)作(zuo)環境與勞(lao)(lao)動(dong)(dong)(dong)(dong)合同(tong)約(yue)定的(de)(de)內(nei)容不符,勞(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)都可(ke)以(yi)(yi)以(yi)(yi)此(ci)理由(you)提(ti)出解除勞(lao)(lao)動(dong)(dong)(dong)(dong)合同(tong)。用(yong)人單(dan)(dan)位隨意(yi)強行給員工(gong)“放假”或“停(ting)工(gong)”,無疑剝奪了(le)勞(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)的(de)(de)工(gong)作(zuo)權利,讓勞(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)失去賴以(yi)(yi)工(gong)作(zuo)的(de)(de)基本條件(jian),因此(ci)可(ke)視為未(wei)提(ti)供勞(lao)(lao)動(dong)(dong)(dong)(dong)條件(jian)。
