我來公司(si)的時候沒有簽合同,想問一(yi)下,沒簽訂合同怎么(me)證實事實勞動(dong)關(guan)系(xi)啊?

用(yong)(yong)(yong)人(ren)單(dan)位(wei)(wei)招用(yong)(yong)(yong)勞(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)未訂(ding)立(li)(li)書面(mian)勞(lao)(lao)動(dong)(dong)(dong)合(he)同(tong),但同(tong)時具備下(xia)列情(qing)形的(de)(de),勞(lao)(lao)動(dong)(dong)(dong)關系成(cheng)立(li)(li): 1)用(yong)(yong)(yong)人(ren)單(dan)位(wei)(wei)和勞(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)符合(he)法律、法規規定的(de)(de)主體資(zi)格; 2)用(yong)(yong)(yong)人(ren)單(dan)位(wei)(wei)依法制定的(de)(de)各項勞(lao)(lao)動(dong)(dong)(dong)規章適(shi)用(yong)(yong)(yong)于勞(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe),勞(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)受用(yong)(yong)(yong)人(ren)單(dan)位(wei)(wei)的(de)(de)勞(lao)(lao)動(dong)(dong)(dong)管(guan)理,從事用(yong)(yong)(yong)人(ren)單(dan)位(wei)(wei)安排的(de)(de)有報酬的(de)(de)勞(lao)(lao)動(dong)(dong)(dong); 3)勞(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)提供的(de)(de)勞(lao)(lao)動(dong)(dong)(dong)是用(yong)(yong)(yong)人(ren)單(dan)位(wei)(wei)的(de)(de)業務組成(cheng)部分。用(yong)(yong)(yong)人(ren)單(dan)位(wei)(wei)沒有在(zai)用(yong)(yong)(yong)工(gong)之日起(qi)建(jian)立(li)(li)勞(lao)(lao)動(dong)(dong)(dong)合(he)同(tong),還需要(yao)向員(yuan)(yuan)工(gong)每月支付兩倍的(de)(de)工(gong)資(zi);超過一年(nian)仍未訂(ding)立(li)(li)書面(mian)勞(lao)(lao)動(dong)(dong)(dong)合(he)同(tong),則視為用(yong)(yong)(yong)人(ren)單(dan)位(wei)(wei)與員(yuan)(yuan)工(gong)已(yi)訂(ding)立(li)(li)無固定期限勞(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)。
