問(wen) 我來公司的時候沒有簽合同(tong),想問一(yi)下,沒簽訂合同(tong)怎(zen)么證實事實勞動關系啊?

用(yong)人(ren)單(dan)(dan)位(wei)(wei)(wei)招用(yong)勞(lao)(lao)動(dong)(dong)者未(wei)訂立書面勞(lao)(lao)動(dong)(dong)合(he)(he)同(tong),但同(tong)時具備下列(lie)情形的(de)(de),勞(lao)(lao)動(dong)(dong)關系成立: 1)用(yong)人(ren)單(dan)(dan)位(wei)(wei)(wei)和勞(lao)(lao)動(dong)(dong)者符(fu)合(he)(he)法律(lv)、法規(gui)規(gui)定(ding)的(de)(de)主體資(zi)格; 2)用(yong)人(ren)單(dan)(dan)位(wei)(wei)(wei)依法制定(ding)的(de)(de)各項勞(lao)(lao)動(dong)(dong)規(gui)章適用(yong)于勞(lao)(lao)動(dong)(dong)者,勞(lao)(lao)動(dong)(dong)者受(shou)用(yong)人(ren)單(dan)(dan)位(wei)(wei)(wei)的(de)(de)勞(lao)(lao)動(dong)(dong)管(guan)理,從事(shi)用(yong)人(ren)單(dan)(dan)位(wei)(wei)(wei)安(an)排的(de)(de)有報酬(chou)的(de)(de)勞(lao)(lao)動(dong)(dong); 3)勞(lao)(lao)動(dong)(dong)者提供(gong)的(de)(de)勞(lao)(lao)動(dong)(dong)是用(yong)人(ren)單(dan)(dan)位(wei)(wei)(wei)的(de)(de)業務組成部分(fen)。用(yong)人(ren)單(dan)(dan)位(wei)(wei)(wei)沒有在用(yong)工(gong)(gong)之日起建立勞(lao)(lao)動(dong)(dong)合(he)(he)同(tong),還(huan)需要向(xiang)員(yuan)工(gong)(gong)每月支付兩倍的(de)(de)工(gong)(gong)資(zi);超(chao)過一年仍未(wei)訂立書面勞(lao)(lao)動(dong)(dong)合(he)(he)同(tong),則視為(wei)用(yong)人(ren)單(dan)(dan)位(wei)(wei)(wei)與員(yuan)工(gong)(gong)已訂立無固定(ding)期限勞(lao)(lao)動(dong)(dong)合(he)(he)同(tong)。
