試用期期間離職是否要提前一個月申請?

答 《勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同法》第10條規(gui)定:建(jian)立勞(lao)(lao)(lao)動(dong)(dong)(dong)關系,應(ying)當(dang)訂(ding)(ding)立書面勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同。已建(jian)立勞(lao)(lao)(lao)動(dong)(dong)(dong)關系,未同時訂(ding)(ding)立書面勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同的,應(ying)當(dang)自用工之日起(qi)一個(ge)月內(nei)訂(ding)(ding)立書面勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同。第30條規(gui)定:用人單位應(ying)當(dang)按照勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同約定和國家(jia)規(gui)定,向勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)及時足額支(zhi)付勞(lao)(lao)(lao)動(dong)(dong)(dong)報酬。由此(ci)可見(jian),該公司不(bu)(bu)與勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)簽訂(ding)(ding)勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同、不(bu)(bu)給(gei)勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)繳納社會保險費本身就是違法的,勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)有權(quan)隨時辭(ci)職,無需提前一個(ge)月申請(qing)。
