《勞(lao)(lao)動(dong)(dong)合(he)同(tong)法》第(di)10條規定(ding)(ding):建(jian)立(li)(li)勞(lao)(lao)動(dong)(dong)關(guan)系(xi),應當訂(ding)(ding)立(li)(li)書面勞(lao)(lao)動(dong)(dong)合(he)同(tong)。已建(jian)立(li)(li)勞(lao)(lao)動(dong)(dong)關(guan)系(xi),未同(tong)時訂(ding)(ding)立(li)(li)書面勞(lao)(lao)動(dong)(dong)合(he)同(tong)的(de)(de),應當自用(yong)工之日起一(yi)(yi)個(ge)月內(nei)訂(ding)(ding)立(li)(li)書面勞(lao)(lao)動(dong)(dong)合(he)同(tong)。第(di)30條規定(ding)(ding):用(yong)人單位(wei)應當按照勞(lao)(lao)動(dong)(dong)合(he)同(tong)約定(ding)(ding)和國家規定(ding)(ding),向勞(lao)(lao)動(dong)(dong)者及時足額支付勞(lao)(lao)動(dong)(dong)報(bao)酬。由此可見,該公司不與(yu)勞(lao)(lao)動(dong)(dong)者簽訂(ding)(ding)勞(lao)(lao)動(dong)(dong)合(he)同(tong)、不給勞(lao)(lao)動(dong)(dong)者繳納社會(hui)保險費本身就是違法的(de)(de),勞(lao)(lao)動(dong)(dong)者有(you)權隨(sui)時辭職,無需提(ti)前一(yi)(yi)個(ge)月申請(qing)。
