簽署的集體合同,出現勞動爭議怎么辦?

我(wo)來公司的時候簽署的是集體合同,想咨(zi)詢一下(xia),出現勞動爭議怎么(me)辦?

在用(yong)人(ren)(ren)單(dan)位(wei)與(yu)勞(lao)(lao)動(dong)(dong)(dong)者(zhe)之(zhi)間如果因(yin)集體(ti)合(he)(he)(he)同(tong)(tong)發(fa)生爭(zheng)議(yi),除了(le)雙方可(ke)以協商(shang)(shang)解決(jue)以外,也同(tong)(tong)樣(yang)可(ke)以通過勞(lao)(lao)動(dong)(dong)(dong)仲(zhong)裁(cai)(cai)、訴(su)(su)訟(song)(song)等方式解決(jue)集體(ti)合(he)(he)(he)同(tong)(tong)爭(zheng)議(yi)。 根據《勞(lao)(lao)動(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)法(fa)(fa)(fa)》規定,用(yong)人(ren)(ren)單(dan)位(wei)如違反集體(ti)合(he)(he)(he)同(tong)(tong),侵犯職工(gong)勞(lao)(lao)動(dong)(dong)(dong)權益(yi),工(gong)會(hui)(hui)可(ke)以依法(fa)(fa)(fa)代表勞(lao)(lao)動(dong)(dong)(dong)者(zhe)要求用(yong)人(ren)(ren)單(dan)位(wei)承擔(dan)責任;集體(ti)合(he)(he)(he)同(tong)(tong)爭(zheng)議(yi)經協商(shang)(shang)解決(jue)不(bu)成的(de),工(gong)會(hui)(hui)可(ke)以依法(fa)(fa)(fa)申請仲(zhong)裁(cai)(cai)、提起(qi)訴(su)(su)訟(song)(song)。 關于(yu)這一(yi)點(dian),在《勞(lao)(lao)動(dong)(dong)(dong)法(fa)(fa)(fa)》中(zhong)有更詳細(xi)的(de)規定:“因(yin)履行(xing)集體(ti)合(he)(he)(he)同(tong)(tong)發(fa)生爭(zheng)議(yi),當事人(ren)(ren)協商(shang)(shang)解決(jue)不(bu)成的(de),可(ke)以向勞(lao)(lao)動(dong)(dong)(dong)爭(zheng)議(yi)仲(zhong)裁(cai)(cai)委員會(hui)(hui)申請仲(zhong)裁(cai)(cai);對仲(zhong)裁(cai)(cai)裁(cai)(cai)決(jue)不(bu)服的(de),可(ke)以自收到仲(zhong)裁(cai)(cai)裁(cai)(cai)決(jue)書之(zhi)日起(qi)十(shi)五日內向人(ren)(ren)民(min)法(fa)(fa)(fa)院(yuan)提起(qi)訴(su)(su)訟(song)(song)。”
