按照《勞(lao)動(dong)(dong)合同法》的(de)(de)(de)有(you)(you)關規定,在(zai)試用(yong)(yong)期內,只(zhi)有(you)(you)當勞(lao)動(dong)(dong)者(zhe)具(ju)有(you)(you)下述法定情形(xing)之一時,用(yong)(yong)人(ren)(ren)(ren)(ren)單(dan)位(wei)(wei)才(cai)可以辭退勞(lao)動(dong)(dong)者(zhe): (1)勞(lao)動(dong)(dong)者(zhe)在(zai)試用(yong)(yong)期間(jian)被證明不(bu)(bu)符合錄用(yong)(yong)條件的(de)(de)(de); (2)勞(lao)動(dong)(dong)者(zhe)嚴(yan)重(zhong)違(wei)反用(yong)(yong)人(ren)(ren)(ren)(ren)單(dan)位(wei)(wei)規章制(zhi)度的(de)(de)(de); (3)勞(lao)動(dong)(dong)者(zhe)嚴(yan)重(zhong)失職,營私舞弊,給用(yong)(yong)人(ren)(ren)(ren)(ren)單(dan)位(wei)(wei)造成重(zhong)大損(sun)害的(de)(de)(de); (4)勞(lao)動(dong)(dong)者(zhe)同時與其他(ta)用(yong)(yong)人(ren)(ren)(ren)(ren)單(dan)位(wei)(wei)建立勞(lao)動(dong)(dong)關系,對完成本單(dan)位(wei)(wei)的(de)(de)(de)工(gong)(gong)作(zuo)(zuo)任(ren)務造成嚴(yan)重(zhong)影響,或(huo)者(zhe)經(jing)用(yong)(yong)人(ren)(ren)(ren)(ren)單(dan)位(wei)(wei)提出,拒不(bu)(bu)改(gai)正的(de)(de)(de); (5)勞(lao)動(dong)(dong)者(zhe)以欺詐(zha)、脅(xie)迫的(de)(de)(de)手段或(huo)者(zhe)乘人(ren)(ren)(ren)(ren)之危,使用(yong)(yong)人(ren)(ren)(ren)(ren)單(dan)位(wei)(wei)在(zai)違(wei)背真實(shi)意思(si)的(de)(de)(de)情況下訂立勞(lao)動(dong)(dong)合同的(de)(de)(de); (6)勞(lao)動(dong)(dong)者(zhe)被依法追究刑(xing)事(shi)責任(ren)的(de)(de)(de); (7)勞(lao)動(dong)(dong)者(zhe)患(huan)病或(huo)者(zhe)非(fei)因工(gong)(gong)負傷,在(zai)規定的(de)(de)(de)醫療(liao)期滿后(hou)不(bu)(bu)能從(cong)事(shi)原工(gong)(gong)作(zuo)(zuo),也不(bu)(bu)能從(cong)事(shi)由用(yong)(yong)人(ren)(ren)(ren)(ren)單(dan)位(wei)(wei)另行安排(pai)工(gong)(gong)作(zuo)(zuo)的(de)(de)(de); (8)勞(lao)動(dong)(dong)者(zhe)不(bu)(bu)能勝任(ren)工(gong)(gong)作(zuo)(zuo),經(jing)過(guo)培訓(xun)或(huo)者(zhe)調整工(gong)(gong)作(zuo)(zuo)崗位(wei)(wei),仍(reng)不(bu)(bu)能勝任(ren)工(gong)(gong)作(zuo)(zuo)的(de)(de)(de)。除(chu)(chu)上述情形(xing)外,用(yong)(yong)人(ren)(ren)(ren)(ren)單(dan)位(wei)(wei)不(bu)(bu)得在(zai)試用(yong)(yong)期內解除(chu)(chu)勞(lao)動(dong)(dong)合同。
