按照《勞(lao)動(dong)(dong)(dong)合同(tong)法(fa)》的(de)(de)有關規定(ding),在(zai)(zai)試(shi)用(yong)期內,只有當勞(lao)動(dong)(dong)(dong)者具(ju)有下述(shu)法(fa)定(ding)情(qing)(qing)(qing)形(xing)之一時,用(yong)人(ren)單(dan)(dan)位(wei)(wei)(wei)(wei)才(cai)可以(yi)辭退勞(lao)動(dong)(dong)(dong)者: (1)勞(lao)動(dong)(dong)(dong)者在(zai)(zai)試(shi)用(yong)期間被證(zheng)明不(bu)符合錄用(yong)條件的(de)(de); (2)勞(lao)動(dong)(dong)(dong)者嚴(yan)重(zhong)違(wei)反用(yong)人(ren)單(dan)(dan)位(wei)(wei)(wei)(wei)規章制度的(de)(de); (3)勞(lao)動(dong)(dong)(dong)者嚴(yan)重(zhong)失職,營私舞弊(bi),給用(yong)人(ren)單(dan)(dan)位(wei)(wei)(wei)(wei)造(zao)成(cheng)(cheng)(cheng)重(zhong)大損(sun)害(hai)的(de)(de); (4)勞(lao)動(dong)(dong)(dong)者同(tong)時與其他用(yong)人(ren)單(dan)(dan)位(wei)(wei)(wei)(wei)建立勞(lao)動(dong)(dong)(dong)關系,對完成(cheng)(cheng)(cheng)本單(dan)(dan)位(wei)(wei)(wei)(wei)的(de)(de)工(gong)作任務造(zao)成(cheng)(cheng)(cheng)嚴(yan)重(zhong)影(ying)響(xiang),或者經用(yong)人(ren)單(dan)(dan)位(wei)(wei)(wei)(wei)提出,拒不(bu)改正的(de)(de); (5)勞(lao)動(dong)(dong)(dong)者以(yi)欺詐、脅迫的(de)(de)手段或者乘人(ren)之危(wei),使用(yong)人(ren)單(dan)(dan)位(wei)(wei)(wei)(wei)在(zai)(zai)違(wei)背真實意思的(de)(de)情(qing)(qing)(qing)況下訂(ding)立勞(lao)動(dong)(dong)(dong)合同(tong)的(de)(de); (6)勞(lao)動(dong)(dong)(dong)者被依法(fa)追究(jiu)刑事(shi)(shi)責任的(de)(de); (7)勞(lao)動(dong)(dong)(dong)者患病或者非因工(gong)負傷,在(zai)(zai)規定(ding)的(de)(de)醫療(liao)期滿后不(bu)能(neng)(neng)從(cong)事(shi)(shi)原工(gong)作,也不(bu)能(neng)(neng)從(cong)事(shi)(shi)由用(yong)人(ren)單(dan)(dan)位(wei)(wei)(wei)(wei)另行安排工(gong)作的(de)(de); (8)勞(lao)動(dong)(dong)(dong)者不(bu)能(neng)(neng)勝任工(gong)作,經過培訓或者調整工(gong)作崗位(wei)(wei)(wei)(wei),仍不(bu)能(neng)(neng)勝任工(gong)作的(de)(de)。除(chu)上述(shu)情(qing)(qing)(qing)形(xing)外,用(yong)人(ren)單(dan)(dan)位(wei)(wei)(wei)(wei)不(bu)得在(zai)(zai)試(shi)用(yong)期內解除(chu)勞(lao)動(dong)(dong)(dong)合同(tong)。
