違法約定試用期需要承擔哪些法律責任?

首先單(dan)(dan)位(wei)違反《勞(lao)動(dong)(dong)(dong)合同(tong)法》規定(ding)與勞(lao)動(dong)(dong)(dong)者(zhe)約定(ding)試(shi)(shi)用期(qi)的(de)(de),由勞(lao)動(dong)(dong)(dong)行(xing)政部門對于其尚(shang)未履行(xing)的(de)(de)情況責令限(xian)期(qi)改(gai)正。其次(ci)違法約定(ding)的(de)(de)試(shi)(shi)用期(qi)已經履行(xing)的(de)(de),由單(dan)(dan)位(wei)以員(yuan)工試(shi)(shi)用期(qi)滿月工資為(wei)標準,按照已經履行(xing)的(de)(de)超過法定(ding)試(shi)(shi)用期(qi)的(de)(de)期(qi)間(jian)向勞(lao)動(dong)(dong)(dong)者(zhe)支(zhi)付(fu)賠償金,即使(shi)單(dan)(dan)位(wei)沒有(you)降(jiang)低員(yuan)工在試(shi)(shi)用期(qi)期(qi)間(jian)的(de)(de)工資待遇,仍會(hui)因違法約定(ding)的(de)(de)行(xing)為(wei)向員(yuan)工支(zhi)付(fu)賠償金。
